Information received concerning alleged trafficking of a group of more than 700 people, including children, allegedly trafficked and detained in unlawful places of detention under the control of traffickers, including in a warehouse in Tazirbu. We would also like to bring to your attention the situation of 120 persons who were allegedly released by Libyan authorities, from an unofficial place of detention, in February 2023, and subsequently transferred to an undisclosed location, where it is alleged, they continued to be detained, without being provided with access to lawyers, or to any assistance or protection, and with limited investigations undertaken in relation to the allegations of trafficking and other serious human rights violations, including torture, inhuman and degrading treatment, rape and sexual violence, and the risk of enforced disappearance, forced labour and sexual slavery. In this context we would also like to bring to your Excellency’s Government attention information we have received concerning alleged trafficking of a group of more than 700 people, including children, allegedly trafficked and detained under the control of traffickers, in locations in Tazirbu, and who have been allegedly released by Libyan authorities in previous operations.

Information received concerning the practice of forced conversions and marriages affecting women and girls from religious minorities, with particular reference to the cases of 5 individuals, members of the Christian and Hindu communities in Pakistan ranging in age from 13 to 20 at the time of their abductions, who have reportedly been forcibly converted to Islam and married against their will. In six out of seven of these cases, the victim was reportedly underage at the time of their forced marriage, and the consent of their legal guardians was not provided. These individual cases are not exceptions, but are indicative of a wider phenomenon throughout the country.

Information received concerning allegations of cross-border artillery shelling and small arms fire allegedly by Saudi security forces causing the deaths of up to 430 and injuring 650 migrants, including refugees and asylum seekers, in Sa'dah governorate, Yemen, and Jizan province, Saudi Arabia, between 1 January and 30 April 2022. These events appear to occur as part of a series of gross human rights violations against migrants, including torture, arbitrary detention, trafficking in person, and sexual abuse, in the adjacent border region in Yemen. It is alleged that neither the Saudi nor the de facto Yemeni authorities have launched effective investigations to clarify the circumstances of these events and the deaths caused.

Information received concerning the situation of migrant domestic workers who have reached for help from or have been abandoned by their employers or sponsors at their consulates and embassies as a consequence of a) the economic crisis in Lebanon and b) COVID-19. They are reportedly facing serious protection risks, including deprivation, exploitation and abuse and are unable to afford food, accommodation, healthcare and basic necessities. Many asked for assistance to be repatriated to their countries, but are unable to bare the costs of the flight tickets. A large proportion of the women migrant workers are Ethiopian nationals, and some are from other African and Asian countries. There are reports of frequent deaths, including suicides, of migrant workers who lost their jobs and have been stranded without being able to return to their countries of origin. The domestic workers were vulnerable to abuse and exploitation perior to the crisis. Allegedly, many of the domestic workers have been exploited and abused, also as a result of the Kafala system. If no action is taken, migrant domestic workers who have become homeless might face acute starvation and further exploitation and abuse.

Comunicación relativa al desarrollo de tres procesos judiciales sobre violaciones manifiestas de las normas internacionales de derechos humanos y violaciones graves del derecho internacional humanitario, ocurridas durante el período del conflicto armado interno en Guatemala. Según las informaciones recibidas, procedimientos judiciales habrían iniciado en tres causas conocidas por los nombres de CREOMPAZ; Molina Theissen; y Sepur Zarco. Dieciocho militares en situación de retiro habrían sido objeto de órdenes de captura y habrían sido acusados de varios delitos incluyendo delitos de lesa humanidad, masacres, desaparición forzada, incluso en el caso de un niño, Marco Antonio Molina Theissen, así como la esclavitud sexual y laboral de mujeres q’eqchíes que vivían en la comunidad de Sepur Zarco, donde estaba ubicada una base militar durante la época del conflicto armado interno. En el contexto de estos procesos judiciales, se reportan un creciente número de mensajes y actos intimidatorios, incluyendo de grupos ligados a los militares acusados, que buscarían desacreditar y presionar a las víctimas y a quienes les apoyan en este proceso. Allegations concerning the reported abduction and subsequent forced conversion and marriage of a 15 year old Hindu girl, in Allah Dino Magsi Village, Qambar Shahdadkot, Sindh province. On 19 April 2015, six men allegedly kidnapped a 15 year old girl in her home at 1 p.m. in front of her parents. Thereafter her parents reportedly tried to register a First Information Report at the police station on several occasions but were repeatedly sent away. On 25 April 2015, a statement from the girl was reportedly published in a newspaper in which she declared that she was 22 years old, had converted to Islam, changed her name and had married a boy. The parents allegedly brought the case to the Session Court of Qambar Shahdadkot, Larkana, which decided on 2 June 2015 to have the girl placed in a shelter called Dar-ul-Aman and have her age determined. One of the alleged perpetrators reportedly filed an application before the High Court Sindh, Circuit Court, Larkana to challenge the decision of the judge from the Session Court. On 24 June 2015, the High Court allegedly judged that the girl was an adult under Sharia law and suspended the decision of the Session Court thus sending her back to live with the aforementioned boy.

Allegations concerning the possible detrimental impact of the ongoing reform of the 1929 Child Marriage Restraint Act on the rights of women and girls in Bangladesh. According to the information received, the Government of Bangladesh is currently reforming the 1929 Child Marriage Restraint Act. It is alleged that a proposed amendment includes an exception to the current minimum age of marriage of 18 for girls and 21 for boys. The suggested provision allegedly allows for the marriage of girls from the age of 16 with the consent of parents and the agreement of the court. It is further alleged that the revised Act has not been shared with civil society. Concern is expressed regarding the aforementioned envisaged exception in the revised Act which would in effect condone and legitimize child and forced marriages.

Allegations of mass summary executions of Yezidi men and of forced conversion to Islam and deportation of Yezidi women and girls held captive by the so-called Islamic State from Iraq to Syria. According to the information received, up to 2,500 members of the Yezidi minority community, who are being held by the so-called Islamic State (ISIL) in the territory of Tal Afar in Iraq’s Nineveh province, have been forced to convert to Islam. Older girls and young women have allegedly been sold to, abused, sexually exploited and enslaved by ISIL fighters. On 26 April 2015, ISIL troops moved the 2,500 captive members of the Yezidi minority community to a school in Tal Afar. Subsequently, up to 700 men and teenage boys were reportedly separated from the rest of the group and moved to the village of Jino near Tal Afar. Furthermore, girls of a young age were reportedly also separated from the rest of the group. On 27 April 2015, up to 400 Yezidi men, from the above-mentioned group, were executed in an unknown location in Ayathiya and/or Zummar sub-districts. The remaining women and children are allegedly to be moved to Syria.

Allegations of abduction, rape and trafficking of two minors and the subsequent refusal of the police to register the complaints. According to information received, on 2 December 2013, Ms. X, 16 years old, was abducted and trafficked across the border while travelling from Asuraina Village Development Committee (VDC) to Hattiban, a town near the Indian border. She remained in captivity for 18 days during which she was sexually abused. She managed to escape and return to Nepal where she tried to file a complaint with the police. However, the police refused to register the first information report (FIR). Ms. Y, 17 years old, was abducted by a neighbour and his son on 16 June 2014 in the Rupandehi district. Her mother witnessed the abduction. The police refused to register a complaint that the victims’ brother was trying to file on 27 June 2014 because one of the perpetrators had filed an injunction before the District Court. Ms. Y’s whereabouts are still unknown.

Alleged discriminatory legislation and practices against women and girls in the Republic of Yemen allowing for child marriage and trafficking in girls for sexual purposes or “tourism marriage”. According to the information received, since the Personal Status Law No. 20 of 1992 was abrogated in 1999, there is no legislative framework in Yemen expressly specifying a minimum age of marriage. Current law permits marriage of a girl less than 15 years old, with the consent of her guardian. In 2009, the Government of Yemen reportedly introduced a bill proposing a minimum age of marriage for both girls and boys of 17 years. Following a debate in the Yemeni national Parliament in 2010, the Shari’a Legislative Committee reportedly made recommendations against establishing a minimum age of marriage, claiming that setting such a minimum age contradicted Islamic principles. Subsequent discussion of the bill was postponed.

Alleged trafficking of migrant workers for the purpose of labour exploitation and debt bondage by Natural Fruit Company Ltd.; alleged civil and criminal charges brought by Natural Fruit Company Ltd. against a human rights defender. According to the information received, Natural Fruit Company Ltd. has confiscated migrant workers’ identification documents and work permits and placed them into debt bondage. The company allegedly continues to be in violation of Thai labour laws with regards to minimum wages, working hours, entitlement to paid sick leave and conditions of work. In addition, Mr. Andy Hall, a human rights defender and lead-researcher in Thailand for Finnwatch, a Finnish non-governmental organization focusing on corporate responsibility, has faced a series of civil and criminal charges brought by Natural Fruit Company Ltd. after publication of the Finnwatch report “Cheap has a high price: Responsibility problems relating to international private label products and food production in Thailand.” Natural Fruit Company Ltd. was one of the companies investigated for this report. Mr. Hall was the subject of an earlier communication sent to the Government of Thailand on 26 April 2013, see A/HRC/24/21, case no. THA 4/2013. A second communication was sent to Vita Food Factory, another Thai business enterprise, which faces similar allegations of human rights abuses, on 15 July 2014, see above, case no. OTH 6/2014. Natural Fruit Company Ltd. and Vita Food Factory were the subjects of a previous communication sent to the Government of Thailand on 7 April 2014, see a/HRC/27/72, case no. THA 2/2014.

Allegations concerning cases of bonded labour in Odisha, India. According to the information received, the hands of Mr. Nilambar Dhangada Majhi and Mr. Jialu Nial, two labourers from the Kalahandi district, were reportedly cut off by a labour contractor after they tried to escape. The aforementioned individuals were reportedly part of a group of 12 labourers, who were brought from their villages beginning of December 2013 to work in a brick kiln in Andhra Pradesh. It is reported that the contractor forcibly tried to take the labourers to another State (to Raipur in Chhatishgarh). All of the labourers reportedly got off the train at Gondia and Nagpur and managed to escape, with the exception of Mr. Nilambar and Mr. Jialu who were caught at Raipur on 9 December 2013. It is reported that they were brought back to Kalahandi on 15 December 2013 and the contractor demanded them to repay the advance payment of all the labourers. When they pleaded their inability to do so, their right hands were allegedly cut off and they were dumped on the road.

However, upon arrival in the country in February 2006, they were forced into prostitution. Less than four months following their arrival, reports indicate that the police raided the brothel where they were forced to work in. The two victims were initially arrested for irregularly residing in the country but after screening interviews the charges were dropped and they were repatriated to Thailand. After their return, the two women pressed charges and on 12 October 2007 the Court of First Instance of Thailand convicted the accused under the Act to Prevent and Suppress Prostitution and handed her an 18 year imprisonment sentence as well as compensation for the victims. It is alleged that the accused escaped from Thailand to Italy before the verdict was delivered and that the conviction has yet to be enforced and compensation paid.

Allegations concerning legislation which discriminates against women and girls, including provisions allowing for child marriage, including between a child and legal guardian, and polygamy. According to the information received, article 1401 of the Civil Code of the Islamic Republic of Iran provides for marriage of girls at 13 years; the 2013 Family Protection Law of the Islamic Republic of Iran reportedly allows for two types of marriage contracts, full or temporary, and polygamy is also legal under this law. Furthermore, on 22 September 2013, the Islamic Consultative Assembly reportedly ratified the “Unsupervised or III Supervised Children and Youth Protection Bill”, Article 27 of which allows for a marriage between a child and his/her legal guardian in circumstances where a child “has reached maturity / puberty” and “marriage with the guardian would be in the best interests of the child”.

Allegations of forced labour in prison amounting to slavery and acts of retaliation by prison authorities. This communication follows up to an earlier UA submitted on 8 October 2013 (current report, RUS 8/2013), regarding the situation of Ms Nadezhda Tolokonnikova. The original UA related to allegations of forced labour in prison amounting to slavery, which reportedly resulted in retaliation by prison authorities, a hunger strike by Ms Tolokonnikova, and her hospitalization. No response to the previous UA was received by Government authorities at the time of writing. According to the updated information received, Ms Tolokonnikova was repeatedly denied access to members of her legal team. Since 8 October 2013, she has also been transferred to a number of different prisons, including transit prisons with authorities allegedly refusing to reveal her exact whereabouts, which remained at the time of writing still unknown. Interventions by Ombudsman, Parliamentary deputies and others at the national level have not succeeding in clarifying her location and wellbeing.

Allegations of forced labour in prison which do not comply with international standards, threats as a consequence of complaint, hunger strike and hospitalization. According to the information received, Ms Nadezhda A. Tolokonnikova, a woman held in correctional colony no. 14 (Mordoviya Republic), and other prisoners in the same facility, were forced to work for up to 16 hours per day. They were only able to sleep 4 hours per night, and were not provided the rest days they were entitled to. The sewing equipment they used to make police uniforms was reportedly outdated, leading to injuries and the remuneration received for the work did not comply with international standards. It is alleged that complaints by Ms Tolokonnikova led to retaliation and threats against her by the deputy governor of the colony. In protest against the conditions of work, Ms Tolokonnikova subsequently went on a hunger strike. Her health reportedly deteriorated and on 29 September 2013, she was transferred from solitary confinement to a hospital, where for some time, she was reportedly denied access to visitors, including her husband.

Alleged abduction, forced conversion and forced marriage of three Hindu women, and death threats against two parliamentarians who criticized a Supreme Court decision that allowed their return to their alleged kidnappers. According to the information received, Ms. X, Ms. Lata Kumari and Ms. Y were kidnapped, forcefully converted to Islam, and forced into marriage in early 2012. It is reported that the Supreme Court intervened in these cases and on April 18, 2012, ordered that the women be allowed to decide whether they wished to remain with their husbands. They agreed to do so. It is alleged that the Court did not take into consideration the violent nature of the abduction, and the climate of fear and intimidation faced by these women and their families, when requesting them to take a decision. After the Supreme Court hearings, Messrs. Khursheed Khokhar and Pitamber Sewani, criticized this decision and later received death threats for defending minority rights in the country.

Alleged trafficking of migrant workers from Cambodia and Myanmar for the purpose of labour exploitation and debt bondage. According to information received, Mr. X, a Cambodian in his thirties came to Thailand in December 2010 through a broker, CDM Trading Manpower Co Ltd, based in Cambodia. He entered into a contract with CDM to work at Phatthana Frozen Food Factory in Thailand. It is reported that his salary, attendance bonus and working days were less than what was stipulated in his contract. Accommodation and health care were allegedly not provided for. Moreover, part of his salary and his passport are reportedly withheld by his employer, to prevent him from leaving until his debts are settled. Reportedly, other cases point to a pattern of trafficking of migrant workers from Cambodia and Myanmar for labour exploitation and debt bondage in Thailand, particularly those working in Phatthana Frozen Food Factory and Vita Food Factory.

Allegations of repeated physical and sexual abuse of an Ethiopian migrant domestic worker, leading to suicide. According to the information received, Ms. Alem Dechasa, a 33-year-old Ethiopian migrant domestic worker, was repeatedly physically and sexually abused by her employer. As a result of fleeing her employer’s house and seeking assistance at the Ethiopian Consulate in Lebanon, Alem Dechasa was physically beaten and forcibly dragged into a car by two men. It is alleged that Alem Dechasa was later taken to a mental institution where she committed suicide.

Alleged trafficking of girl children from the districts of 24 North Parganas and Murshidabad, West Bengal State, for the purpose of sexual exploitation, and the alleged systematic failure of the police to investigate such incidents. According to the information received, Ms. A, aged about 14 years old, was trafficked on 9 October 2011 to Karnataka State, for prostitution. She was later rescued. Ms. B, aged about 14 years, was trafficked from her village. It is alleged that she was held in captivity and raped before her rescue. Ms. C, aged about 15 years old, was trafficked from her village on 30 May 2011, to Bangalore, where she was allegedly sold into prostitution. The victim to date has not been rescued. Ms. D, about 15 years old, was trafficked into Bangladesh. The victim allegedly married Mr X, and was allegedly sold by her husband into sex slavery in Bangladesh.

Alleged negative impact of the United Kingdom of Great Britain and Northern Ireland (UK) government proposal to abolish the Overseas Domestic Worker (ODW) visa system. According to the information received, the ODW visa system has been hailed as best practice and provides important safeguards to prevent abuse, exploitation and trafficking of migrant domestic workers. If the ODW visa system is abolished, this will contribute to facilitating contemporary forms of slavery practices, including trafficking, by allowing employers to bring migrant workers to the UK with no legal protection. Migrant domestic workers would also be tied to their employer and if their rights are violated, they may face the dilemma of continuing to suffer or fleeing and becoming irregular in the UK. Migrant domestic workers themselves would be unable to seek justice through criminal courts or employment tribunals for violations of their right to be free from servitude and other human rights violations.

Alleged trafficking of migrant workers for the purpose of labour exploitation. According to the information received, Mr. Kyaw Kyaw, a 25 year-old man from Myanmar, came to Mae Sot, Thailand in April 2009. In September that year he met a broker who offered him 8,000 baht (US$266) in cash and recruited him for a job. Mr. Kyaw was then allegedly sold to work on a fishing boat, where he worked for 10 months under very harsh conditions. During these months, he reportedly did not receive any salary for his work. After 10 months, he managed to run away. Reportedly, a number of other cases point to a pattern of trafficking of migrant workers for labour exploitation in the fishing industry, particularly in the coastal town of Mahachai in the Samut Sakhon province.

Allégation de détention arbitraire et de mauvais traitements. Selon les informations reçues, après avoir signalé au préfet de la commune d‘Arafat le cas de deux filles mineures prétendument contraintes de travailler comme domestiques, M. Biram Ould Dah Ould Abeid, président de l‘Initiative pour la Résurgence du Mouvement Abolitionniste en Mauritanie (IRA Mauritanie), aurait été frappé à coups de matraques par plusieurs policiers. Blessé à la tête et à la jambe, M. Ould Dah Ould Abeid aurait ensuite été conduit à l'hôpital. A sa sortie d‘hôpital, il aurait été placé en garde à vue au commissariat d'Arafat. Ni sa famille ni son avocat n‘auraient été autorisés à lui rendre visite. M. Dah ould Boushab, M. Mouloud ould Boubi, M. Ali ould Boubarak Fall, M. Sheikh ould Abidin ould Salem et M. Bala Touré, tous collègues de M. Ould Dah Ould Abeid appartenant à l‘IRA Mauritanie, auraient également été arrêtés. Le cas de M.
