Information received concerning the Penal Bill (Amendment – Death Penalty for Terrorists), 5783 2023 (“Bill”), the first reading of which was passed by the Knesset in November 2025. We are concerned that the Bill is inconsistent with Israel’s obligation to protect the right to life under article 6 of the International Covenant on Civil and Political Rights, ratified by your Excellency’s Government in 1991, and related provisions including the prohibition on torture and other cruel, inhuman or degrading treatment or punishment (article 7, ICCPR as well as articles 1, 2 and 16 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or punishment, also ratified by Israel in 1991), non-discrimination and equality (articles 2(1) and 26 of the ICCPR), fair trial (article 14 of the ICCPR), legality (article 15 of the ICCPR) and the right to an effective remedy (article 2(3) of the ICCPR).

Serious concern is expressed at this agreement in light of both States’ international obligations and women victims’ human rights, including the right to truth, justice and reparation. Further serious concern is expressed at the distress in which this agreement has left the surviving women victims by considering this agreement as a “final and irreversible” solution of the issue. Comunicación relativa al desarrollo de tres procesos judiciales sobre violaciones manifiestas de las normas internacionales de derechos humanos y violaciones graves del derecho internacional humanitario, ocurridas durante el período del conflicto armado interno en Guatemala. Según las informaciones recibidas, procedimientos judiciales habrían iniciado en tres causas conocidas por los nombres de CREOMPAZ; Molina Theissen; y Sepur Zarco. Dieciocho militares en situación de retiro habrían sido objeto de órdenes de captura y habrían sido acusados de varios delitos incluyendo delitos de lesa humanidad, masacres, desaparición forzada, incluso en el caso de un niño, Marco Antonio Molina Theissen, así como la esclavitud sexual y laboral de mujeres q’eqchíes que vivían en la comunidad de Sepur Zarco, donde estaba ubicada una base militar durante la época del conflicto armado interno. En el contexto de estos procesos judiciales, se reportan un creciente número de mensajes y actos intimidatorios, incluyendo de grupos ligados a los militares acusados, que buscarían desacreditar y presionar a las víctimas y a quienes les apoyan en este proceso. Allégations de violations des droits à la liberté d’association et liberté d’opinion et expression de plusieurs associations ainsi que du directeur d’un journal indépendant au Burundi. Selon les informations reçues, les comptes bancaires de dix organisations non-gouvernementales auraient été gelés et une ordonnance ministérielle aurait ordonné la suspension de leurs activités. Un ordre d’extradition aurait été formulé contre M. Antoine Kaburahe en lien avec ses activités légitimes en tant que journaliste. Des préoccupations sont exprimées quant au fait que ces mesures cherchent à restreindre les activités légitimes des organisations de la société civile et des médias au Burundi. Des préoccupations sont exprimées quant au fait que ces atteintes au droit à la liberté d’association et au droit à la liberté d’opinion et d’expression auraient lieu dans un contexte de graves violations des droits de l’homme dont seraient responsables notamment les forces de sécurité burundaises, et pourraient faire partie d’une répression systématique de la société civile et des médias indépendants au Burundi. Cette situation pousserait un nombre croissant de défenseurs des droits de l’homme et de journalistes à fuir le pays.

Allegations concerning the imminent execution of two individuals in Bangladesh following unfair trials. According to the information received, in 2013, Mr. Ali Ahsan Mohammad Mujahid and Mr. Salauddin Quader Chowdhury were sentenced to death by the International Crimes Tribunal of Bangladesh on charges of war crimes and genocide. Their trial and appeal processes reportedly failed to meet international standards on fair trial and due process. On 17 and 18 November 2015, the Appelate Division of the Supreme Court rejected the defendants’ review applications, which were effectively their last appeal. The defendants may be executed at any time. Mr. Chowdhury and Mr. Mujahid were the subject of two previous communications sent on 3 October 2012, see A/HRC/22/67, case no. BGD 6/2012, and 16 November 2012, see A/HRC/22/67, case no. BGD 8/2012. Mr. Chowdhury was also the subject of one earlier communication sent on 21 February 2011, see A/HRC/18/51, case no. BGD 2/2011.

Allegations relative to judicial proceedings, with no access to appeal procedures, against a journalist and a group of 23 individuals for exercising their legitimate right to freedom of expression. According to the information received, on 2 December 2014, Mr. David Bergman, a journalist, was convicted and sentenced by the International Crimes Tribunal of Bangladesh under contempt of court charges for having published on his blog three articles challenging the ‘death figure’ of the 1971 Liberation War and expressing criticism of the Tribunal. Reportedly after 49 persons signed a letter expressing concern at his conviction, 23 of them were charged for contempt and, on 10 June 2015, one of the signatories, Mr. Zafrullah Chowdhury, was found guilty by the Tribunal. It is further reported that the law does not provide access to appeal in such cases. Following a petition with the High Court division of the Supreme Court, Mr. Chowdhury made an “Application for Complete Justice” at the Appellate Division of the Supreme Court of Bangladesh, the hearing of which is due to take place on 26 July 2015.

Allégations de torture d’un citoyen italien d’origine marocaine, dans le cadre du programme de détention secrète, transfert et torture mis en place par la Central Intelligence Agency des États-Unis après le 11 septembre 2001. Selon les informations reçues, M. Abou Elkassim Britel aurait été maintenu en détention secrète au Pakistan et au Maroc, avec la complicité présumée des autorités italiennes, ainsi que la complicité du Portugal, sous la forme de soutien logistique au programme de transfert, entre mars 2002 et avril 2011. Au cours de cette période, M. Britel a été soumis à de la torture et à des mauvais traitements, sans accès ou avec des obstructions à l’accès, à sa famille ou à des avocats, et n’a pas été présenté devant un tribunal dans un délai raisonnable. À ce jour, il semble qu’aucune enquête n’ait été ouverte en ce qui concerne les faits allégués et aucune réparation ou réhabilitation psychologique au médicale adéquate ne semble avoir été apportée à M. Allégations relatives à l’usage excessif de la force par la police contre des manifestants qui aurait entrainé la mort de plusieurs d’entre eux, ainsi qu’à l’arrestation de plus de 200 manifestants, à la suspension de l’émission de plusieurs radios et à l’arrestation et détention provisoire d’un défenseur des droits de l’homme. Selon les informations reçues, le 26 avril 2015, de larges manifestations pacifiques auraient eu lieu à Bujumbura contre la candidature de l’actuel président Pierre Nkurunziza à la prochaine élection présidentielle. La police aurait tenté de disperser les manifestants et utilisé des gaz lacrymogènes, des canons à eau, des grenades et des armes à feux à balles réelles. Certains rapports indiquent un bilan d’au moins six morts, dont un policier, et 15 blessés au cours des affrontements, et plus de 200 arrestations de manifestants. Le gouvernement aurait interdit la réalisation et émission de reportages en direct des lieux des manifestations par la Radio Publique Africaine (RPA), la Radio Isanganiro et la Radio Bonesha FM. Le 27 avril 2015, M. Pierre-Claver Mbonimpa, défenseur des droits de l’homme, aurait été arrêté à la Maison de la Presse de Bujumbura alors qu’il s’y rendait pour donner une interview. M. Alegaciones relativas a la decisión del Consejo de Ministros de rechazar las solicitudes de extradición de varios ciudadanos españoles, presentadas por autoridades judiciales argentinas, con relación a una serie de delitos que incluirían violaciones graves de los derechos humanos y crímenes de lesa humanidad cometidos durante el franquismo. Según la información recibida, el 13 de marzo de 2015, el Consejo de Ministros habría tomado la decisión de rechazar dicha solicitud de extradición, sin iniciar procedimientos judiciales a nivel nacional para investigar y sancionar a los responsables de violaciones graves de los derechos humanos, incluyendo tortura, ejecuciones sumarias y desapariciones, cometidas durante el régimen franquista. Esta decisión negaría los derechos de las víctimas y sus familiares a la justicia y a la verdad. Se expresa grave preocupación por los argumentos esgrimidos por el Gobierno, los cuales ignorarían las normas y estándares internacionales de los derechos humanos, así como las recomendaciones formuladas por varios mecanismos internacionales de derechos humanos.

Allegations concerning the slow progress of the trial in the case of the “Maguindanao Massacre”, the killing of witnesses to the trial, and the lack of reparations to the victims. According to the information received, the trial on the massacre of 58 persons, including 24 women and 30 journalists, started in 2010 before the Regional Trial Court of Quezon City; however, not a single case has been concluded. Reportedly, at least four witnesses have been killed and relatives of witnesses have also reported attacks, threats and harassment. No form of reparation has been provided to the victims. Media coverage of the trial has reportedly been banned since mid-2014. This case was the subject of earlier communications sent on 30 November 2009, see A/HRC/14/23/Add.1, paras.1840-1880 (case no. Alleged court application for the closure of an umbrella human rights organization and defamation of an affiliated non-governmental organization (NGO). According to the information received, on 17 January 2013, the Ministry of Justice warned that the Historical, Educational, Human Rights and Charitable Society Memorial (Society Memorial) had violated the Law governing NGOs. On 21 July 2014, the Ministry registered Human Rights Centre Memorial (HRC Memorial), which is a member of Society Memorial, as a “foreign agent”. That decision is under appeal. On 24 September 2014, the Ministry filed a case with the Supreme Court, citing infringements of the law. A hearing was to be held on 13 November 2014 but was deferred to 17 December at the request of the Ministry. On 26 September 2014, members of HRC Memorial were allegedly denied access to the villages of Vremenniy and Gymry, in Dagestan, during investigations carried out by them into alleged human rights violations. On 10 October 2014, state television channel NTV broadcasted footage of the attempted visit and accused members of HRC Memorial of providing support to terrorists allegedly hiding in Vremenny. The above-mentioned laws and HRC Memorial were the subject of three previous communications dated 13 June 2013, see A/HRC/25/74, case no. RUS 3/2013; 18 December 2013, see A/HRC/26/21, case no. Alleged attacks, threats and acts of intimidation against members of a non-governmental organization (NGO) actively involved in commemorating the Srebrenica genocide of 1995. According to the information received, on 8 July 2014, during a commemoration of the genocide, Ms. Staša Zajovic, co-founder of the NGO Women in Black, and three staff members of the same organization, were physically and verbally attacked in Valjevo by a group of assailants, some of whom were wearing t-shirts bearing the image of Bosnian Serb General Ratko Mladic. The police reportedly failed to provide adequate protection. Prior to this incident, the then spokesperson of the Anti-Terrorist Unit of the Ministry of Interior had incited hooligans to act violently against members of Women in Black. A nationalist right wing organization also organized a hostile protest in front of the organization’s premises.

Allegations concerning the confirmation of death sentences against 220 individuals in Egypt, following unfair and politically motivated trials. According to the information received, on 24 March 2014, a Court in Minya sentenced 529 people to death on charges related to an attack in August 2013 on a police station in Matay, in protest of the violent dispersal of supporters of former President Mohamed Morsi. The sentences were pronounced following legal proceedings reportedly marred with irregularities. On 28 April 2014, another group of 683 individuals were provisionally sentenced to death by the same Court in connection to an attack on a police station in al-Adwa, following a similar trial purportedly similarly procedurally flawed. Also on 28 April 2014, the Court confirmed 37 of the 529 provisional death sentences imposed on 24 March 2014. On 21 June 2014, the Court upheld 183 of the 683 provisional death sentences imposed on 28 April 2014. The defendants are all allegedly supporters of former president Mohamed Morsi.

Alegaciones de abuso de poder por parte del Tribunal de Honor del Colegio de Abogados y Notarios de Guatemala que suspendió a una jueza del ejercicio de la profesión de abogada por un año. Según la información recibida, el Tribunal de Honor informó el 4 de abril de 2014 a la Jueza Yassmin Barrios que iba a ser sancionada pecuniariamente, amonestada y suspendida en el ejercicio de su profesión de abogada por un año por haber supuestamente cometido una falta grave durante el juicio contra el Sr. Efraín Ríos Montt y el Sr. José Mauricio Rodríguez Sánchez por genocidio y delitos contra los deberes de humanidad. Se informa que el abogado que habría presentado la denuncia ante el Tribunal de Honor era uno de los defensores del imputado Rodríguez Sánchez. Se alega que el Tribunal de Honor actuó fuera de su competencia y que el órgano legalmente competente para evaluar las actuaciones de los jueces e imponerles las sanciones disciplinarias, la Junta de Disciplina Judicial, ya había desestimado la misma denuncia. Se expresa profunda preocupación ante la decisión emitida por el Tribunal de Honor que se enmarca en un contexto de ataques, amenazas e intimidación que afecta a los operadores de justicia que luchan contra la impunidad de graves violaciones a los derechos humanos en Guatemala. La Jueza Barrios ya fue objeto de un llamamiento urgente previo en el cual se denunciaban supuestas amenazas e intimidaciones, enviada con fecha 30 de octubre de 2013, ver A/HRC/25/74, no. de caso GTM 9/2013.

The communication addresses the situation surrounding the decision of the Constitutional Court of Bosnia and Herzegovina of 22 October 2013 ordering the quashing of the verdicts in the cases of ten individuals convicted of war crimes against civilians and genocide, following the decision of the European Court of Human Rights (ECtHR) in the case of Maktouf and Damjanovic vs. Bosnia and Herzegovina. Concerns are raised as to the legal developments in Bosnia and Herzegovina following the domestic application of this ECtHR judgement, specifically about the following issues: 1) the apparent automatic application of the aforementioned ECtHR judgment in at least a dozen cases in Bosnia and Herzegovina in contravention of the actual ruling of the same judgment; 2) the release of the defendants, guilty of genocide and war crimes against civilians, without remand pending re-trial, and its impact on the protection of victims from violence, re-victimization and intimidation; and 3) the lack of a comprehensive transitional justice strategy to complement the criminal justice process in the country.

Il a été rapporté qu’une enquête serait en cours. Les familles de victimes de disparition forcée n'auraient cependant pas été dument informées du déroulement et possibles conclusions d’une enquête. Des préoccupations sont exprimées concernant les articles 45 et 46 de l’ordonnance n° 06-01 du 28 Moharram 1427, correspondant au 27 février 2006, portant sur la mise en œuvre de la Charte pour la Paix et la Réconciliation Nationale, notamment à l’égard du droit à la vérité et l’accès à la justice.

Presunto cierre de la Oficina de Tutela Legal (Tutela Legal) de la Arquidiócesis de San Salvador y de su archivo que contendría información sobre casos de violaciones a los derechos humanos, incluyendo desapariciones forzadas. Según la información recibida, el día 30 de septiembre de 2013, la Arquidiócesis de San Salvador decretó el cierre de la Oficina de Tutela Legal de dicho Arzobispado. Se expresa preocupación por la protección de los aproximadamente 50.000 archivos en poder de Tutela Legal y por la preservación de la confidencialidad de los datos que contiene. Se señala la importancia del resguardo del Archivo, por el riesgo que podría representar para numerosas víctimas, familiares y testigos y para la promoción de la verdad, la justicia, la reparación y las garantías de no-repetición. La decisión de cerrar la Oficina de Tutela Legal ocurre diez días después de la admisión por la Sala de lo Constitucional de una demanda de inconstitucional contra la Ley de Amnistía General para la Consolidación de la Paz; proceso que podría permitir la apertura de procesos judiciales y en el marco de los cuales la documentación y archivos de la Oficina de Tutela Legal podrían jugar un rol central.

Presunto cierre de la Oficina de Tutela Legal (Tutela Legal) de la Arquidiócesis de San Salvador y de su archivo que contendría información sobre casos de violaciones a los derechos humanos, incluyendo desapariciones forzadas. Según la información recibida, el día 30 de septiembre de 2013, la Arquidiócesis de San Salvador decretó el cierre de la Oficina de Tutela Legal de dicho Arzobispado. Se expresa preocupación por la protección de los aproximadamente 50.000 archivos en poder de Tutela Legal y por la preservación de la confidencialidad de los datos que contiene. Se señala la importancia del resguardo del Archivo, por el riesgo que podría representar para numerosas víctimas, familiares y testigos y para la promoción de la verdad, la justicia, la reparación y las garantías de no-repetición. La decisión de cerrar la Oficina de Tutela Legal ocurre diez días después de la admisión por la Sala de lo Constitucional de una demanda de inconstitucional contra la Ley de Amnistía General para la Consolidación de la Paz; proceso que podría permitir la apertura de procesos judiciales y en el marco de los cuales la documentación y archivos de la Oficina de Tutela Legal podrían jugar un rol central.

Presuntas amenazas de muerte e intimidaciones contra una jueza en Guatemala. Según las informaciones recibidas, la Sra. Yassmin Barrios, Presidenta del Tribunal que juzgó durante 2013 un caso por delitos de genocidio y de lesa humanidad, habría recibido amenazas de muerte e intimidaciones que pudieran poner en riesgo su vida y su integridad física y mental. La jueza habría recibido una llamada del extranjero en la que se le comunicaba un plan para asesinarla. La Jueza Barrios presidió el tribunal que llevó a cabo el juicio contra el ex jefe de Estado, Efraín Ríos Montt, y el ex jefe de inteligencia, José Mauricio Rodríguez Sánchez, por genocidio y crímenes de lesa humanidad, el cual se desarrolló entre el 19 de marzo y el 10 de mayo de 2013. La patrulla asignada para vigilar su residencia habría sido retirada en varias ocasiones sin justificación, dejándola sin protección adecuada. El 28 de junio de 2013, la Comisión Interamericana de Derechos Humanos otorgó medidas cautelares a favor de la Jueza Barrios.

Presunta clausura y potencial clausura de ciertos casos judiciales relativos a desapariciones forzadas, tortura y ejecución ocurridos durante el período dictatorial uruguayo. Según la información recibida, con fechas 22 de febrero de 2013, 8 de marzo de 2013, 13 de marzo de 2013, y 8 de abril de 2013 la Suprema Corte de Justicia de Uruguay ha resuelto la inconstitucionalidad de los artículos 2 y 3 de la Ley 18.831 de 2011 que habilitaba la investigación de los delitos cometidos por oficiales de las fuerzas armadas y policiales durante el período dictatorial finalizado en 1985 e impedía la aplicación de plazos de prescripción a los mismos por considerarlos delitos de lesa humanidad. Según se informa, estas decisiones de la Suprema Corte de Justicia consideran que la referida norma viola el principio de constitucionalidad legal y de irretroactividad de la ley penal más gravosa estableciendo así la imposibilidad de que esa ley opere retroactivamente y declarando la prescripción de los delitos cometidos durante la dictadura.

Alleged threats of violence widely published in mass media and official harassment of human rights defenders and an alleged physical attack against a human rights defender. According to the information received, Ms. Mandira Sharma and Messrs. Subodh Pyakhurel, Kanak Mani Dixit, Sushil Pyakhurel, Charan Prasai and Kapil Shrestha, all members of the Accountability Watch Committee (AWC), have been the subject of stigmatising remarks in newspapers, online news portals and on radio stations. These reports have also included calls to 'people's action' against them, understood in the Nepalese context to imply violent attacks. All these media are reportedly affiliated with a Maoist political party currently in government. It is alleged that the threats have been motivated by AWC efforts in securing the arrest in Britain of an army colonel now being investigated for torture incidents in Nepal in 2005 as well as the arrest of Maoist cadres for the murder of a journalist in 2004. Additionally, Ms. Mandira Sharma has received messages of an investigation being opened against the organisation, Advocacy Forum, of which she is the head, potentially putting its human rights activities at risk. Furthermore, Mr.Yadav Prasad Bastola, the executive director of the Human Rights Alliance, was allegedly attacked by six unidentified masked persons on 28 February 2013 while walking home.

Allégations quant à certaines dispositions du projet de loi portant création, mandat, composition, organisation et fonctionnement de la Commission Vérité et Réconciliation. Selon les informations reçues, la dernière version du projet de loi pose six préoccupations majeures, notamment : 1) pardon et la réconciliation, 2) la stratégie globale concernant les mesures de justice transitionnelle, 3) l’indépendance et l’impartialité de la CVR, y compris la procédure de sélection de ses membres, 4) le mandat de la CVR, 5) l’amnistie pour les crimes de génocide, crimes de guerre, crimes contre l’humanité, crimes de violences sexuelles et des violations flagrantes des droits de l’homme et 6) la protection des victimes et des témoins.

Alleged increasing climate of violence in the context of the protests related to the trials before the Bangladesh International Crimes Tribunal. According to the information received, large-scale protests have been held across Bangladesh since 5 February 2013. The protests were reportedly triggered by the pronouncement of verdicts against the leaders of the opposition Party Jamaat-e-Islami before the Bangladesh International Crimes Tribunal. It is alleged that the protests turned violent, leading to clashes and attacks, including lethal attacks, perpetrated by both State and non-State actors. At least 88 persons were allegedly killed from 5 February to 5 March 2013. A large number of deaths were reportedly caused by the excessive use of force by the security forces while policing the protests. It is reported that serious attacks occurred against the members of the Hindu community, as well as against journalists and other media workers. At the time of drafting this communication, the protests and the ensuing violence in Bangladesh was still on-going. The proceedings undertaken and the sentences pronounced by the Bangladesh International Crimes Tribunal have been the subject of previous communications (see A/HRC/22/67, case no BGD 6/2012 and BGD 8/2012, and A/HRC/23/51, case no BGD 3/2013).

Presuntos actos de hostigamiento contra colaboradores de la Comisión de la Verdad para la Investigación de las Violaciones a los Derechos Humanos Durante la Guerra Sucia de los años sesenta y setentas del Estado de Guerrero. Según las informaciones recibidas, los días 26, 27 y 28 de enero de 2013, varios individuos habrían preguntado por el Sr. Carlos Ernesto López, un miembro del equipo de investigadores especializados en documentación de la Comisión, en la zona donde vive. Posteriormente, el Sr. López habría recibido un mensaje amenazante. El autor del mensaje le habría advertido que sabía dónde vivía y que iría allí a menos que despidiera a uno de sus empleados sin remplazarlo. El 3 de febrero de 2013, el Sr. Miguel Flores Leonardo, sobreviviente de una presunta desaparición forzada e hijo de un presunto desaparecido, habría afirmado que una persona asociada con él habría recibido amenazas. El autor de una de las presuntas amenazas se habría referido al Sr. Flores Leonardo.

Alegaciones de existencia de un clima de violencia e intimidación en contra de abogados, jueces, fiscales y otros sujetos procesales, que actualmente se padece en el país. Según se informa, esto afecta especialmente a aquéllos operadores de justicia que conocen procesos penales de alto riesgo e impacto social, particularmente los relacionados con casos de corrupción así como casos de graves violaciones a los derechos humanos ocurridas en el pasado, como crímenes de genocidio y lesa humanidad. Respecto a la grave situación de los operadores de justicia que trabajan en casos relacionados con la corrupción, nos referimos en particular al asesinato el 14 de febrero de 2013 de la abogada penalista la Sra. Lea De León.

Possible promulgation of an ordinance that would allegedly contravene international standards and promotion of public officials allegedly involved in serious human rights violations or violations of international humanitarian law in the context of the armed conflict in Nepal. According to the information received, in the absence of a legislative body, on 28 August 2012, the Council of Ministers transmitted an ordinance establishing a Commission on Investigation of Disappeared Person, Truth and Reconciliation to the President of Nepal. In the event the ordinance is promulgated, the Commission would reportedly be vested with the competence to recommend to the Government the granting of amnesties including for crimes under international law. Additionally, the Commission would have the competence to initiate reconciliation processes in the absence of an application from the victim or the perpetrator.

The National Truth Commission of Brazil was formally constituted with the appointment of the Commission members on 16 May. Since the signing into law by President Rousseff in November 2011, this is the next critical step towards the establishment of the National Truth Commission responsible for investigating human rights violations, including killings, torture and forced disappearances committed under military rule between 1964 and 1985. The Special Rapporteurs referred to the benefits of a commission of inquiry (A/HRC/19/61) and the integral role the mechanism can provide to facilitating the formal investigation of legacies of killings, torture and other forms of ill-treatment, and pave the way to effective and fair prosecutions. Reference was also made to HRC Res. 18/7 of the Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence, who can contribute, upon request, to the provision of technical assistance or advisory services on issues pertaining to that mandate.
