Alleged high levels of lead found in water consumed by residents of Flint, Michigan; and allegations that Flint is not an isolated incident but that disproportionate health risks are faced by communities and/or people of lower socio-economic standing due to toxics, pollution and other hazardous substances and wastes in the United States of America. According to the information received, inhabitants of the city of Flint were consuming water contaminated with lead when the state of Michigan changed the source for tap water in April 2014 but failed to apply standards to prevent contamination of the water. Allegations concerning the Government of Hungary’s actions aimed at preventing the mobility of asylum seekers and migrants onto and/or within its territory. According the information received, since April 2015, the Government has taken a number of measures aimed at preventing asylum seekers and migrants from either entering or exiting the country. In May, the Government mailed more than eight million questionnaires entitled “national consultation on immigration and terrorism” to its citizens reportedly inciting hatred and actively promoting hostility towards migrants. In early June, the Government reportedly launched a controversial billboard campaign against migration. On 17 June 2015, the Minister of Foreign Affairs and Trade announced the closure of the Hungarian-Serbian border by erecting a four-meter-high fence by the 175-kilometre long border section. In July, Hungary’s parliament passed new legislation tightening asylum rules. On 1 September, the Hungarian police reportedly sealed off a major railway station in Budapest in order to prevent migrants from leaving Hungary. Allegations of incitement to discrimination and violence against members of the Rohingya community by a prominent member of a political party. According to information received, a politician addressing a rally in Yangon in May 2015, can be seen in a video encouraging the crowd to “kill and bury” all the Rohingyas. The crowd can be heard cheering and repeating his statements. The same politician is also reported to have addressed another meeting in May 2015, where he called upon the public to demand to the authorities to “shoot boat people whenever sighted on the sea and border”. Allegations of acts of discrimination based on race or religion have also been reported against the Rohingyas. Alleged discriminatory nature of a package of four Bills seeking to “protect race and religion”. According to the information received, the Bills discriminate against ethnic and religious minorities, as well as against women. The Religious Conversion Bill establishes a State-regulated system for changing religion, which contravenes the right to freedom of religion and belief. The Population Control Healthcare Bill adopts a selective and coercive approach to improving living standards. This includes a potential requirement of birth spacing that would violate women’s right to choose freely and responsibly the number and spacing of their children and could be used to target areas with large minority communities. The Buddhist Women’s Special Marriage Bill regulates interfaith marriages between Buddhist women and non-Buddhist men and is discriminatory on many grounds. Alleged incidents of racial and xenophobic violence, and attacks perpetrated against immigrants, refugees and asylum-seekers in different parts of South Africa. According to the information received, between 6 and 29 April 2015, at least four foreigners and three South African nationals, including a 14-year-old boy, were killed in attacks in Durban, properties were looted and over 1,000 people, including refugees and asylum-seekers, were displaced. The attacks targeted African immigrants, including those from Zimbabwe, Ethiopia and Somalia, and included violence against journalists covering these incidents and police. The unrests started in Isipingo and Chatsworth, where several grocery shops owned by foreign nationals were vandalized, and spread to KwaMakhutha and Umlazi. It is alleged that these attacks have left some 5,300 foreigners homeless in Durban; these persons are being assisted in four sites through municipal and provincial disaster management responses. Also, approximately 1,800 people are estimated displaced in Ekurhuleni Municipality in Gauteng following similar attacks. Allegations concerning a racist statement made by a Member of Parliament in political discourse. According to the information received, on 13 July 2013, Senator Roberto Calderoli, while addressing the Northern League political rally in Treviglio, stated that the Minister of Integration, Ms. Cécile Kyenge, who was born in the Democratic Republic of the Congo and has Italian citizenship, would be better off working as a minister “in her country.” He also reportedly said: “I love animals – bears and wolves, as is known – but when I see the pictures of Kyenge I cannot but think of the features of an orang-utan, even if I’m not saying she is one”. On 28 January 2015, the Immunity Board of the Senate completed its examination of the issue of accountability for the opinions expressed by the Mr. Calderoli. It decided that Mr. Calderoli’s words did not have any racist connotation but were pronounced in the exercise of political power. Alleged torture of African Americans and other minorities at Area 2 and 3 Police Headquarters in the city of Chicago from 1972 through 1991. According to the information received, African Americans and other minorities were subjected to various forms of torture, including with the purpose of obtaining confessions, which in turn resulted in incarcerations and death sentences. Some victims have been released because of evidence proving that Chicago police, under the direction of a former Police Commander, obtained their confessions through torture, while others victims, who were reportedly tortured into their confessions, remain incarcerated. To this date, no Chicago police officer or city official has been convicted for any acts of torture, and the United States’ government has failed to abrogate the legislation that allows for impunity. Allegations of the killing of a young African-American man, and of the subsequent excessive use of force and acts of intimidation against demonstrators and journalists in the city of Ferguson, Missouri. According to the information received, a series of largely peaceful protests have recently taken place in the city of Ferguson in response to the police shooting of Mr. Michael Brown, a local African-American teenager, on 9 August 2014. They have reportedly been met with excessive use of force by law enforcement officials, who have shot tear gas and rubber bullets at protesters and bystanders, including journalists. Allegations of ongoing attacks against persons with albinism resulting in death or severe maiming, and of lack of adequate protection. According to the information received, persons with the genetic condition of albinism are being targeted in brutal, ritualized attacks for the harvesting of their body parts throughout the territory of the United Republic of Tanzania. It is reported that at least 139 attacks took place throughout Tanzania between 2007 and 2014. Investigations, prosecutions and sentencing concerning cases involving attacks against persons with albinism are extremely rare. It is further reported that when legal proceedings do occur, due process is typically not afforded to the victims, whose testimony is usually not considered, and who are not provided with legal assistance. Furthermore, persons with albinism living in State institutions are subjected to inhumane living conditions and treatment. Children in particular are allegedly subjected to severe mistreatment in the form of physical abuse and sexual violence. Allegations of disproportionate punishment of four Israeli medical students based on their nationality, and subsequent biased public statements against foreign students made by a high-ranking official of the Bureau on Migration and Asylum. According to the information received, on 3 May 2014, a group of allegedly drunk Moldovans provoked four Israeli nationals residing in Moldova as students - Messrs. Matani Muhammad, Abu Ahmad Jihad, Dallashi Abd Alkader and Dallasheh Hamzeh - with ethnically tainted statements outside of a restaurant in Chisinau. The provocation led to a fight, following which the Israelis’ were each given a 400 MDL fine (approximately 29 USD), expulsion orders and a five-year residence ban for constituting threats to the State, thereby effectively terminating their medical studies. Alleged prosecution and conviction of a domestic violence survivor, after she fired a warning shot into the ceiling, during an altercation with her abuser. According to the information received, Ms. Marissa Alexander, an African-American woman from Florida, was arrested on 1 August 2010, after shooting upward into the ceiling during an altercation with her abusive husband. Ms. Alexander reportedly had earlier obtained a court issued “Injunction for Protection” against her husband. It is reported that no one was injured from the shot fired by Ms. Alexander. She was nonetheless, charged with three counts of aggravated assault with a deadly weapon with no intent to harm. Subsequent to her sentencing, Ms. Alexander filed for appeal, and her retrial is scheduled for July 28, 2014. Alleged incidents of racial and xenophobic violence and attacks against foreigners and migrants. According to the information received, these attacks took place after an alleged murder committed by a migrant from the North Caucasus on the night of 9-10 October 2013 in Moscow’s Biryulyovo district. After this event, several incidents of alleged racially motivated violence and attacks against foreigners and migrants occurred in different locations across Russia. On 13 October 2013, thousands of people marched through the Biryulyovo district in Moscow at night, demanding that the police find the alleged killer. Clashes ensued when riot police confronted protesters and were pelted with bottles, sticks and rocks. Allegations concerning possible undue delay of the ongoing review of the death of Trayvon Martin and possible discriminatory impact on African Americans of national laws. Alleged violation of the rights of persons belonging to a Roma community, including their right to adequate housing. According to the information received, on 14 August, at 12 p.m., Roma people living at Granite street, Uzhgorod, Transcarpathia region, informed local Roma NGOs about a visit to their community by representatives of prosecutors, police and journalists headed by the Mayor of the city. The Roma community stated that they were being given notice that they must move out of their homes. They were reportedly informed that the reason for their eviction was the illegal construction of the Roma homes on the land. It is reported that 22 houses, inhabited by 147 people (19 families), including 80 children, are under immediate threat of demolition. The police allegedly went into individual Roma houses and asked for registrations, acting in a “rough” manner towards the Roma. Allegations concerning police violence and harassment against the residents of a Roma settlement at the outskirts of Moldava nad Bodvou, in eastern Slovakia. According to the information received, in the night of 15 to 16 June 2013 two policemen from the Slovak Republic Police reportedly violently and arbitrarily arrested a 17-year-old male resident of the above mentioned Roma settlement triggering a strong reaction among the residents, some of whom threw stones at the police car which lead to another arrest of a man with severe intellectual disabilities. On 19 June 2013, 60 policemen, of whom 15 were masked, entered the settlement for a purported search operation which was reported to be a planned retaliatory police raid following the incident of 15-16 June. Allegedly, in the course of the raid, police beat several men, women and children with truncheons. At least 30 people were reportedly injured. New amendment to introduce an anti-caste legislation in the UK. According to information received, on 4 March 2013, the House of Lords of the United Kingdom of Great Britain and Northern Ireland voted in favour of amendment number 37 to the House of Lord Bill 95 which called for caste to be recognized among other forms of discrimination in the Equality Act, 2010. On 23 April 2013, the House of Commons voted in favour. It is reported that caste-based discrimination exists in the United Kingdom and specifically within the Indian community and there is no official data on the Dalit population in the UK who constitute the main victims of caste based discrimination in the country. Allegation that a draft law commemorating persons who fought along with the German Nazi Army was proposed to the Latvian Parliament on 22 November 2012. According to the information received, the draft law grants a number of benefits via the establishment of the “Status of a Person Conscripted during the Second World War” to Latvian veterans who fought from 5 August 1940 to 8 May 1945, voluntarily or not, whether for the German Nazi Army or the Soviet Army. Non-citizens veterans who fought during the same period, the majority of which allegedly belong to the Russian speaking minority in Latvia, are excluded from such preferential status. Possible establishment of a compensation mechanism for victims of non-consensual sterilizations in the Czech Republic. According to the information received, on 9 September 2004, the first in a series of complaints was filed to the Public Defender of Rights (“Ombudsman”) of the Czech Republic by a group of Romani women with allegations of non-consensual sterilization. These led first to a comprehensive report on the issue by the Ombudsman in 2005, and then in 2009 to an official expression of regret by the Government. On 17 February 2012, the Government Council for Human Rights recommended payment of compensation to all women victims of sterilization procedures carried out not in conformity with the legislation. Alleged negative consequences of the upcoming deadline of the nationality verification process on migrant workers from Myanmar. According to the information received, the Nationality Verification process for workers from Myanmar has to be completed by 14 December 2012. It is reported that after the deadline, regularisation of irregular workers in Thailand will no longer be possible, and all five Myanmar temporary Nationality Verification centres should be closed and no longer issue passports or visas. Furthermore, it is reported that only legal import of workers from Myanmar under the Memoranda of Understanding process will be permitted, and Thai law enforcement authorities will implement a crackdown to remove irregular workers from Myanmar. Allégations d’une expulsion par des habitants du quartier Nord de la ville de Marseille de familles Roms. Selon les informations reçues, le 27 septembre 2012 une cinquantaine d’habitants de la cité des Créneaux dans les quartiers Nord de Marseille se seraient rassemblés pour procéder à l’expulsion de familles Roms, y compris des enfants, installées sur un terrain vague. Contraints à la fuite sous la menace et les insultes des habitants et des riverains, les familles Roms ont dû quitter le campement avec caravanes et véhicules, laissant derrière eux des effets personnels que les habitants du quartier auraient brûlés avec le reste du campement. La passivité et l’inaction des pouvoirs publics et de la police avant et après l’incident ont été rapportées. Alleged discriminatory restrictions and systematic violations of the right to freedom of religion or belief of Chin Christians in Myanmar. According to the information received, Chin Christians face many difficulties in getting permission to renovate or construct a church or to erect a Christian cross. Reportedly, they had to resort to using “house” churches but more than 100 churches, including “house” churches were allegedly closed down by the authorities in 2010. Furthermore, Chin Christians must also get permission for religious gathering; even when permission is obtained, gathering is often disbanded by the army. Between 1992 and 2009, 15 separate incidents of monasteries and pagodas were allegedly built using forced labour of the Chin Christians and on land forcibly confiscated from them. It was further alleged that the Chin Christians faced immense pressure to convert during food security crisis in order to obtain humanitarian aid. Alleged negative human rights impacts stemming from the order to ban three humanitarian aid organizations from supporting unregistered Rohingya asylum-seekers, refugees and migrants in and around unofficial camps in the Cox’s Bazar district in south-eastern Bangladesh. According to information received, Médecins Sans Frontières, Action Contre la Faim and Muslim Aid UK received letters on 2 August 2012 from the NGO Affairs Bureau attached to the Office of the Prime Minister, asking them to cease their operations in the Cox’s Bazar district (except in the two official camps, housing some 30,000 Rohingya, run by the Government and supported by the United Nations High Commissioner for Refugees and other partners). Alleged imminent forced eviction of approximately 350 Roma people from the Tor de’ Cenci camp in Rome. According to information received, over 350 people of Roma ethnicity are facing eviction from the Tor de’ Cenci camp in Rome, where they have been living for up to 16 years. The camp was opened by local authorities in 1995 in an area offering adequate services to residents. Authorities planned to complete the eviction by 10 July 2012 and to resettle the Roma families in a new camp called La Barbuta, located in an isolated area next to Ciampino airport. Reportedly local authorities plan to use the camp exclusively to house Roma families currently living in different camps in Rome. Consultations with the Roma residents were reportedly inadequate and no alternative options to relocation to La Barbuta camp were ever discussed. Allegation of incidents of racially motivated violence and attacks against migrants of African origin, and inflammatory and xenophobic statements made in this context against migrants by senior Israeli State officials. According to information received several demonstrations against African migrants, including Sudanese, were held across Israel. During the demonstrations several migrants of African origin were attacked and abused. Cases of serious assaults against sub-Saharan Africans, including firebombs thrown into residences and a nursery, the beating of a hotel employee, fire set to an apartment where Eritrean and Ethiopian migrants were living, as well as the use of clubs and pepper spray in some of the attacks, were reported. Allegation of arbitrary detention and ill-treatment of human rights defender. According to the information received, Mr. Bushra Gamar Hussein has been detained without charge or trial in Khartoum North since 26 June 2011, when he was arrested by National Intelligence and Security Services (NISS). His health has deteriorated and he suffers from multiple health complications, allegedly due to physical and mental abuse suffered while in detention. Reportedly, Mr. Hussein was placed in incommunicado detention in 2011 and he was severely beaten until he went into a coma. He was allegedly forced to stand for long hours during interrogation by NISS officers and he has a prolapsed disc from lying on a hard floor. He was reportedly called a slave and received a death threat due to his Nuba ethnic origin. Alleged physical and verbal attacks and threats against human rights defender and human rights lawyer, and the alleged failure to bring those responsible to justice. According to the information received, on 16 December 2011, Messrs. Panayote Dimitras and Thanassis Tartis were subjected to a physical attack as well as verbal abuse and threats at a court hearing regarding alleged racist remarks made by coastguardsmen in March 2011. It is reported that hundreds of messages were subsequently posted on the Internet in praise of the attack, and further threats were also allegedly posted. It is communicated that no sanctions have been imposed on the perpetrators of these acts. Mr. Dimitras is the Spokesperson of the Greek Helsinki Monitor (GHM) and a member of the World Organisation Against Torture (OMCT) General Assembly. Alleged forced eviction of approximately 1,000 Roma residents (240 families) from the Belvil settlement in Belgrade. According to the information received, on 26 April 2012, approximately 1,000 people, mainly Roma (240 families) were evicted from the informal Belvil settlement in Belgrade. The evicted persons were relocated on the same day to four relocation settlements in Belgrade and to six municipalities outside Belgrade. Allegedly consultations with and information provided to the affected community prior to the eviction were inadequate, prior notice was not adequately given, and housing solutions offered to the evictees did not conform to international standards. While it would seem that those housing solutions are temporary, reportedly no information had been given to the affected community regarding durable alternative housing/resettlement solutions. According to the information received, the act targets immigrants and people perceived to be immigrants, including persons of Hispanic origin, and has led to harassment, intimidation, and punitive sanctions in the state of Alabama. The act reportedly prohibits irregular immigrants from entering into “business transactions” with the state, requires schools to verify the immigration status of their students, provides for prolonged detention without bail for anyone who is suspected of being “unauthorized”, and provides that Alabama courts are not to enforce contracts in which one of the parties is known to be undocumented. Alleged difficulties and obstacles to full voter participation and voting rights particularly for those belonging to minority groups. According to the information received, since 2011, several U.S. States have enacted a broad array of voting restrictions and allegedly discriminatory laws, or have otherwise impeded democratic political participation. These various restrictive measures fall into three general categories, each of which operates at a different point in the voting process: first, at the voter registration stage; second, at the early voting stage; and third, on Election Day itself. These measures and other efforts reportedly have discouraging or impeding impacts on political participation particularly by persons belonging to minority groups, particularly African-Americans and Latinos. Specifically, in 2011, 14 states passed 25 laws that together allegedly block more than 5,000,000 citizens access from voting. According to the information received, on 15 December 2011, a group of 35 Ethiopian Christians was arrested in Jeddah, Saudi Arabia while travelling to their place of worship. Twenty nine women have been held in Amber 2 section of Briman Prison and the six men were held in section 10 of Briman Prison. Alleged building of a wall surrounding apartment building populated mainly by Roma residents, and additional discriminatory treatment in regard to the right to housing. According to the information received, on 28 June 2011, the mayor of Baia Mare city announced the decision to build a 3 meters high and 100 meters long wall, surrounding the apartment building on 46H Horea Street in Baia Mare. Reportedly, most of the residents in the building are Roma people. Furthermore, the Baia Mare Local Council reportedly decided to acquire 10 hectars of land for the purpose of constructing social housing (1000 housing units) and resettle “marginalized communities”. Alleged forced evictions of Roma families in Rome. According to the information received, on 22 April 2011, around 166 Roma living in the Via Del Cluniacensi camp in Rome were forcefully evicted. Two days after the evictions, local authorities reportedly provided temporary alternative accommodation for the evicted communities for two to three months. On 9 and 10 May around 247 persons were allegedly evicted by national and municipal police forces from two Roma camps (via Candoni and via Salaria). Reportedly, on 17 May the police conducted additional evictions in Via Candoni, of families who had returned to the camp and built new shacks following the first eviction on 9 May. Alleged threat of forced eviction against Roma community. According to the information received, in 2006 the Sofia Municipality, Vuzrajdane sub-district, issued eviction orders against the Dobri Jeliazkov Roma community, based on article 65 of the Municipal Property Act. Allegedly, the orders require the residents to vacate and demolish their own homes. The community reportedly challenged the eviction orders before the Sofia City Court, which upheld the orders in 2007. The Sofia City Court decision was appealed before the Supreme Administrative Court, and was upheld. The Sofia Municipality reportedly decided to execute the eviction orders, and a seven day notice was handed to the Dobri Jeliazkov community on 23 June 2011. Alleged violation of due process rights and guarantees in the conduct of criminal proceedings in relation to the June 2010 violence. According to the information received, the alleged unfairness of trials, unequal treatment in the administration of justice and allegations of torture and ill-treatment have exacerbated tensions among ethnic communities, in particular among ethnic Uzbeks. Investigations and trials had reportedly mainly been conducted against ethnic Uzbeks, allegedly failing to uphold due process rights and procedural guarantees. From 27 August 2010 to 31 December 2010, 46 cases of torture and ill-treatment and 93 cases of arbitrary detention or unlawful arrest were reportedly documented. On 26 October, a decision rendered by Osh City Court reportedly stated that Mr. Farruh Gapirov had been beaten and forced to confess to the crime of which he was accused. On 10 November, the Court of Appeal sentenced Mr. Azimjan Askarov, an ethnic Uzbek human rights defender, to life imprisonment. On 26 January 2011, the Supreme Court commenced the review of the case. Mr. Askarov was reportedly in need of urgent medical attention and treatment for injuries likely to have resulted from torture.
