Información recibida en relación con la crisis humanitaria y ambiental que padece el pueblo Raizal de las islas de Vieja Providencia y Santa Catalina, pertenecientes al Archipiélago de San Andrés, Providencia y Santa Catalina, tras el paso de los huracanes Eta e Iota en noviembre de 2020. Casi dos años después del paso y daños causados por los huracanes, la población de la isla de 5000 personas, de la cual 4500 indígenas Raizales, sigue necesitando urgentemente ayuda para el restablecimiento de todas sus necesidades básicas afectadas, como: alojamiento, atención sanitaria, agua, saneamiento y alimentos. Los esfuerzos de reconstrucción del Gobierno, se están llevando a cabo sin tomar en cuenta las aspiraciones y las recomendaciones del pueblo raizal y de sus autoridades, ignorando su forma de vida y sus costumbres, así como el clima de las islas. Debido a la insuficiente adecuación de las nuevas viviendas a las condiciones climáticas de las islas, la situación queda crítica y conlleva el riesgo que las personas interesadas se desplacen de nuevo y se queden sin hogar cuando golpee el próximo huracán. Alleged high levels of lead found in water consumed by residents of Flint, Michigan; and allegations that Flint is not an isolated incident but that disproportionate health risks are faced by communities and/or people of lower socio-economic standing due to toxics, pollution and other hazardous substances and wastes in the United States of America. According to the information received, inhabitants of the city of Flint were consuming water contaminated with lead when the state of Michigan changed the source for tap water in April 2014 but failed to apply standards to prevent contamination of the water. Several alerts and studies were dismissed by the authorities until 1 October 2015 when the Governor of Michigan admitted the gravity of the situation and urged residents to stop drinking water from the tap, declaring a state of emergency on 5 January 2016. Allegation that members of a family in the United States of America suffered and continue to suffer from the adverse impact of toxic mercury which was used as a form of treatment for a sexually transmitted disease in the Rosenwald Fund Study. According to the information received, the Rosenwald Fund Study was launched in 1929 by the Government and involved approximately 40,000 African-Americans from six southern states. It is alleged that participants of the study, including Mr. Chester Noel and other members of his family, have suffered from the adverse effect of mercury and that multiple generations of the Noel family, including Ms. Helen Noel, as the descendants of the original victims exposed to mercury continue to suffer from adverse health impacts. Alleged incidents of racial and xenophobic violence, and attacks perpetrated against immigrants, refugees and asylum-seekers in different parts of South Africa. According to the information received, between 6 and 29 April 2015, at least four foreigners and three South African nationals, including a 14-year-old boy, were killed in attacks in Durban, properties were looted and over 1,000 people, including refugees and asylum-seekers, were displaced. The attacks targeted African immigrants, including those from Zimbabwe, Ethiopia and Somalia, and included violence against journalists covering these incidents and police. The unrests started in Isipingo and Chatsworth, where several grocery shops owned by foreign nationals were vandalized, and spread to KwaMakhutha and Umlazi. It is alleged that these attacks have left some 5,300 foreigners homeless in Durban; these persons are being assisted in four sites through municipal and provincial disaster management responses. Also, approximately 1,800 people are estimated displaced in Ekurhuleni Municipality in Gauteng following similar attacks. Allegations of racial discrimination against people of African descent and lack of access to appropriate medical treatment whilst in detention. According to the information received, Mr. Mumia Abu-Jamal (born Wesley Cook), a 61-year-old Afro-American detainee in State Correctional Institution at Mahanoy, Pennsylvania, has not had access to appropriate medical treatment while in detention. As a consequence his health situation has deteriorated over the past few months resulting in his admission to the intensive care unit (ICU) of a nearby clinic on 30 March 2015 in diabetic shock. It is alleged that as he had three "comprehensive" blood tests since February 2015, diabetes should have been diagnosed and treated accordingly. Instead his medical condition was reportedly ignored by the prison guards. Mr. Abu-Jamal was allegedly detained following an unfair trial which found him guilty of murder of a police officer in 1981. He is reportedly serving a life sentence without parole and has not been given a re-sentencing hearing in violation of Pennsylvania constitutional and statutory law. Allegations concerning a racist statement made by a Member of Parliament in political discourse. According to the information received, on 13 July 2013, Senator Roberto Calderoli, while addressing the Northern League political rally in Treviglio, stated that the Minister of Integration, Ms. Cécile Kyenge, who was born in the Democratic Republic of the Congo and has Italian citizenship, would be better off working as a minister “in her country.” He also reportedly said: “I love animals – bears and wolves, as is known – but when I see the pictures of Kyenge I cannot but think of the features of an orang-utan, even if I’m not saying she is one”. On 28 January 2015, the Immunity Board of the Senate completed its examination of the issue of accountability for the opinions expressed by the Mr. Calderoli. Alleged torture of African Americans and other minorities at Area 2 and 3 Police Headquarters in the city of Chicago from 1972 through 1991. According to the information received, African Americans and other minorities were subjected to various forms of torture, including with the purpose of obtaining confessions, which in turn resulted in incarcerations and death sentences. Some victims have been released because of evidence proving that Chicago police, under the direction of a former Police Commander, obtained their confessions through torture, while others victims, who were reportedly tortured into their confessions, remain incarcerated. Stellio Capo Chichi, alias Kémi Séba, a été arrêté à Paris le 13 septembre 2014, déféré devant un juge et incarcéré à la prison de Fleury-Mérogis. M. Capo Chichi semble avoir été écroué à la suite d’une condamnation à deux mois de prison avec sursis et mise à l’épreuve, prononcée le 22 décembre 2008 par le Tribunal de grande instance de Paris (TGI de Paris). Alleged infringement of due process and fair trial guarantees, including racial discrimination. According to the information received, in July 1998, Mr. Earl Ringo, an African-American then aged 24, was arrested for the murder of two people in Columbia, Missouri, and sentenced to death in 1999. It is reported that Mr. Ringo is scheduled to be executed on 10 September 2014. Concerns are raised about the fairness of the proceedings which reportedly did not fully comply with international human rights law and allegations that race may have been a key factor in the imposition of the death penalty against Mr. Ringo. Allegations of the killing of a young African-American man, and of the subsequent excessive use of force and acts of intimidation against demonstrators and journalists in the city of Ferguson, Missouri. According to the information received, a series of largely peaceful protests have recently taken place in the city of Ferguson in response to the police shooting of Mr. Michael Brown, a local African-American teenager, on 9 August 2014. They have reportedly been met with excessive use of force by law enforcement officials, who have shot tear gas and rubber bullets at protesters and bystanders, including journalists. On 13 and 19 August 2014, four journalists were assaulted by police, detained for a short period of time, and released without charges. According to the information received, judgement TC/0168/13 of the Constitutional Court of the Dominican Republic of 23 September 2013 could have a retroactive effect on the citizenship of a large number of Dominicans of Haitian descent and could strip tens of thousands of people born in the Dominican Republic of their Dominican nationality. Allegations concerning possible undue delay of the ongoing review of the death of Trayvon Martin and possible discriminatory impact on African Americans of national laws. According to the information received, the US Department of Justice’s Criminal Section of the Civil Rights Division, the United States Attorney’s Office for the Middle District of Florida and the Federal Bureau of Investigation continue to evaluate the evidence generated during the federal investigation, as well as the evidence and testimony from the state trial concerning the case involving the death of Trayvon Martin in February 2012. The above Special Procedures mandates appeal to the US Government to finalize without undue delay the on-going review, along with the delivery of justice and appropriate reparations. Alegaciones sobre los daños ocasionados por el vertimiento de sedimentos acumulados en la represa del Bajo Anchicayá a las minorías afrodescendientes que habitan en la zona. Según información recibida, dichos sedimentos provocaron la extinción de la fauna de la cuenca media y baja del río Anchicayá y también la contaminación del río, que era la única fuente de agua potable de dichas minorías, afectando de esta manera al acceso a una alimentación adecuada y al agua potable y energía eléctrica. Asimismo, se expresa preocupación por el hecho de que no existe una sentencia firme y definitiva después de más de diez años desde el vertimiento de los sedimentos.
