Alleged failure of the Government to publish the “Detailed Census Analysis” for the 2012 census, which would provide important data disaggregated by ethnicity and other characteristics, about participation and outcomes for minorities in Guyana in different areas of economic and social life. According to the information received, there are reports of discrimination, in particular of Afro-Guyanese regarding the enjoyment of economic, social and cultural rights, including in the fields of employment, housing, healthcare and education. However, without verifiable data, it is difficult for civil society organizations to draw conclusions or to advance these claims or to effectively advocate around these issues. There is also an alleged lack of investigation of allegations of cases and patterns of discrimination affecting ethnic minorities in Guyana, and lack of responsive mechanisms to respond to such cases.

Allegations of individual human rights violations as well as specific concerns particularly affecting the Afro-Colombian community in the municipality of. Buenaventura, Valle de Cauca Department, Colombia. According to the information received, despite the increased presence of public security forces in Buenaventura since 2014, criminal organized groups continue to exercise strong social, economic and local control over the lives and activities of its inhabitants, including by implementing invisible frontiers and imposing curfews in some of the neighbourhoods. These groups are said to be responsible for various criminal activities such as extortion, death threats, murder, enforced disappearances, imposition of various types of punishments, sexual violence against women and girls, child recruitment and forced displacement and eviction, aimed at taking control of the territory and the different communities living in the urban area of Buenaventura.

Alleged high levels of lead found in water consumed by residents of Flint, Michigan; and allegations that Flint is not an isolated incident but that disproportionate health risks are faced by communities and/or people of lower socio-economic standing due to toxics, pollution and other hazardous substances and wastes in the United States of America. According to the information received, inhabitants of the city of Flint were consuming water contaminated with lead when the state of Michigan changed the source for tap water in April 2014 but failed to apply standards to prevent contamination of the water. Several alerts and studies were dismissed by the authorities until 1 October 2015 when the Governor of Michigan admitted the gravity of the situation and urged residents to stop drinking water from the tap, declaring a state of emergency on 5 January 2016. On 16 January 2016 President Obama declared a Federal state of emergency for Flint in order to speed up distribution of bottled waters and filters. Up to 8,000 children under the age of six are alleged to have been exposed to lead poisoning and will need ongoing medical help with health and behavioural issues.

Allegation that members of a family in the United States of America suffered and continue to suffer from the adverse impact of toxic mercury which was used as a form of treatment for a sexually transmitted disease in the Rosenwald Fund Study. According to the information received, the Rosenwald Fund Study was launched in 1929 by the Government and involved approximately 40,000 African-Americans from six southern states. It is alleged that participants of the study, including Mr. Chester Noel and other members of his family, have suffered from the adverse effect of mercury and that multiple generations of the Noel family, including Ms. Helen Noel, as the descendants of the original victims exposed to mercury continue to suffer from adverse health impacts. Furthermore, it is alleged that the Government has not investigated these allegations and as a result the subjects of the Rosenwald Fund Study and their descendants have not received an effective remedy.

Alleged incidents of racial and xenophobic violence, and attacks perpetrated against immigrants, refugees and asylum-seekers in different parts of South Africa. According to the information received, between 6 and 29 April 2015, at least four foreigners and three South African nationals, including a 14-year-old boy, were killed in attacks in Durban, properties were looted and over 1,000 people, including refugees and asylum-seekers, were displaced. The attacks targeted African immigrants, including those from Zimbabwe, Ethiopia and Somalia, and included violence against journalists covering these incidents and police. The unrests started in Isipingo and Chatsworth, where several grocery shops owned by foreign nationals were vandalized, and spread to KwaMakhutha and Umlazi. It is alleged that these attacks have left some 5,300 foreigners homeless in Durban; these persons are being assisted in four sites through municipal and provincial disaster management responses. Also, approximately 1,800 people are estimated displaced in Ekurhuleni Municipality in Gauteng following similar attacks. These attacks on foreigners follow previous ones which took place between May and June 2014, where several incidents of racially motivated violence and attacks carried out against foreigners and migrants occurred, especially in the provinces of KwaZulu Natal and Gauteng.

According to the information received, Mr. Mumia Abu-Jamal (born Wesley Cook), a 61-year-old Afro-American detainee in State Correctional Institution at Mahanoy, Pennsylvania, has not had access to appropriate medical treatment while in detention. As a consequence his health situation has deteriorated over the past few months resulting in his admission to the intensive care unit (ICU) of a nearby clinic on 30 March 2015 in diabetic shock. It is alleged that as he had three "comprehensive" blood tests since February 2015, diabetes should have been diagnosed and treated accordingly. Instead his medical condition was reportedly ignored by the prison guards. Mr. Abu-Jamal was allegedly detained following an unfair trial which found him guilty of murder of a police officer in 1981. He is reportedly serving a life sentence without parole and has not been given a re-sentencing hearing in violation of Pennsylvania constitutional and statutory law. During his years in detention he has been active in writing about racial discrimination in the criminal justice system and advocating for justice and the rights of his fellow detainees.

Allegations concerning a racist statement made by a Member of Parliament in political discourse. According to the information received, on 13 July 2013, Senator Roberto Calderoli, while addressing the Northern League political rally in Treviglio, stated that the Minister of Integration, Ms. Cécile Kyenge, who was born in the Democratic Republic of the Congo and has Italian citizenship, would be better off working as a minister “in her country.” He also reportedly said: “I love animals – bears and wolves, as is known – but when I see the pictures of Kyenge I cannot but think of the features of an orang-utan, even if I’m not saying she is one”. On 28 January 2015, the Immunity Board of the Senate completed its examination of the issue of accountability for the opinions expressed by the Mr. Calderoli. It decided that Mr. Calderoli’s words did not have any racist connotation but were pronounced in the exercise of political power. Concern is expressed that Mr. Calderoli’s remarks about Ms. Kyenge have racist connotations and are in contravention with the absolute prohibition of racial and ethnic discrimination as stipulated in international human rights law.

Alleged torture of African Americans and other minorities at Area 2 and 3 Police Headquarters in the city of Chicago from 1972 through 1991. According to the information received, African Americans and other minorities were subjected to various forms of torture, including with the purpose of obtaining confessions, which in turn resulted in incarcerations and death sentences. Some victims have been released because of evidence proving that Chicago police, under the direction of a former Police Commander, obtained their confessions through torture, while others victims, who were reportedly tortured into their confessions, remain incarcerated. To this date, no Chicago police officer or city official has been convicted for any acts of torture, and the United States’ government has failed to abrogate the legislation that allows for impunity.

Letter requesting information on the reported placement of the Dutch tradition of Sinterklaas and Black Pete on the National Inventory of Intangible Cultural Heritage. According to the information received, on 15 January 2015, the Dutch Centre for Folk Culture and Intangible Heritage, a Government-funded organization, placed the Dutch traditional Sinterklaas and Black Pete festival on the National Inventory of Intangible Cultural Heritage. Allegedly, concerned communities, who find the tradition of Black Pete to be offensive, as it perpetuates a negative stereotyped representation of African people and people of African descent, were not informed nor consulted about this process. A previous communication on the same subject was sent on 17 January 2013, see A/HRC/23/51, case no. NLD 1/2013.

Decisión del Tribunal Constitucional de la República Dominicana que declara inconstitucional el instrumento de acceso a la jurisdicción de la Corte Interamericana de Derechos Humanos y rechaza una sentencia de la Corte Interamericana que fue objeto de una comunicación enviada el 11 de noviembre de 2013. Según la información recibida, el 4 noviembre de 2014, el Tribunal Constitucional de la República Dominicana decidió que el instrumento de reconocimiento de la competencia de la Corte Interamericana de Derechos Humanos era inconstitucional. El 22 octubre de 2014, la Corte Interamericana había declarado que la decisión del Tribunal Constitucional del 23 de septiembre de 2013, que priva a la mayoría de la población de ascendencia haitiana de su derecho a la nacionalidad dominicana, era discriminatoria y ordenó al Estado a adoptar medidas de reparación adecuadas.

Allegations concerning the arrest of, and criminal proceedings against, eight human rights defenders demonstrating peacefully against unjustified disconnections of water services in Detroit, Michigan. According to the information received, on 18 July 2014, Mr. Hans Barbe, Mr. William Wylie-Kellerman, Ms. Marian Kramer, Ms. Marianne McGuire, Mr. David Olson, Mr. James Perkinson, Ms. Kimberley Redigan and Ms. Joan Smith were arrested following their participation in peaceful demonstrations outside the gates of Homrich Wrecking Inc., a contractor of the City of Detroit Water and Sewer Department, and charged with disorderly conduct pursuant to City of Detroit Ordinance Sec. 38-5-1. These protests reportedly took place against the backdrop of unprecedented disconnections of water services in Detroit to households who cannot afford to pay their bills. Reports indicate that mostly African-Americans living in Detroit were affected by these water cuts. The allegations of unjustified disconnections of water services in Detroit were the subject of a previous communication sent on 24 June 2014, see A/HRC/28/85, case no. USA 9/2014.

Allégation de détention arbitraire d’un citoyen français d’origine Africaine. Selon les informations reçues, M. Stellio Capo Chichi, alias Kémi Séba, a été arrêté à Paris le 13 septembre 2014, déféré devant un juge et incarcéré à la prison de Fleury-Mérogis. M. Capo Chichi semble avoir été écroué à la suite d’une condamnation à deux mois de prison avec sursis et mise à l’épreuve, prononcée le 22 décembre 2008 par le Tribunal de grande instance de Paris (TGI de Paris). Le 10 octobre 2010, un juge de l’’application des peines de Versailles a révoqué le sursis dont bénéficiait M. Capo Chichi, rendant exécutoire sa condamnation à deux mois de prison. Cette décision n’a pas fait l’objet d’un débat contradictoire. Ni M. Capo Chichi, ni son avocate n’auraient été informés de l’audience au cours de laquelle cette décision aurait été prise. Depuis son incarcération, M. Capo Chichi aurait été placé en isolement et n’aurait pas été autorisé à rencontrer son avocate et sa famille.

Alleged infringement of due process and fair trial guarantees, including racial discrimination. According to the information received, in July 1998, Mr. Earl Ringo, an African-American then aged 24, was arrested for the murder of two people in Columbia, Missouri, and sentenced to death in 1999. It is reported that Mr. Ringo is scheduled to be executed on 10 September 2014. Concerns are raised about the fairness of the proceedings which reportedly did not fully comply with international human rights law and allegations that race may have been a key factor in the imposition of the death penalty against Mr. Ringo. Concern is also raised about alleged discrimination against African-Americans in the imposition of the death penalty in the United States of America.

Allegations of the killing of a young African-American man, and of the subsequent excessive use of force and acts of intimidation against demonstrators and journalists in the city of Ferguson, Missouri. According to the information received, a series of largely peaceful protests have recently taken place in the city of Ferguson in response to the police shooting of Mr. Michael Brown, a local African-American teenager, on 9 August 2014. They have reportedly been met with excessive use of force by law enforcement officials, who have shot tear gas and rubber bullets at protesters and bystanders, including journalists. On 13 and 19 August 2014, four journalists were assaulted by police, detained for a short period of time, and released without charges. Alleged possible withdrawal of citizenship of a large number of Dominicans of Haitian Descent after a Constitutional Court judgement in violation of the right to nationality. According to the information received, judgement TC/0168/13 of the Constitutional Court of the Dominican Republic of 23 September 2013 could have a retroactive effect on the citizenship of a large number of Dominicans of Haitian descent and could strip tens of thousands of people born in the Dominican Republic of their Dominican nationality. Allegations concerning possible undue delay of the ongoing review of the death of Trayvon Martin and possible discriminatory impact on African Americans of national laws. According to the information received, the US Department of Justice’s Criminal Section of the Civil Rights Division, the United States Attorney’s Office for the Middle District of Florida and the Federal Bureau of Investigation continue to evaluate the evidence generated during the federal investigation, as well as the evidence and testimony from the state trial concerning the case involving the death of Trayvon Martin in February 2012. The above Special Procedures mandates appeal to the US Government to finalize without undue delay the on-going review, along with the delivery of justice and appropriate reparations. They appeal to the US Government to examine those laws that could have discriminatory impact on African Americans and to ensure that such laws are brought into full compliance with the country’s international legal obligations and relevant international standards.

Alegaciones sobre los daños ocasionados por el vertimiento de sedimentos acumulados en la represa del Bajo Anchicayá a las minorías afrodescendientes que habitan en la zona. Según información recibida, dichos sedimentos provocaron la extinción de la fauna de la cuenca media y baja del río Anchicayá y también la contaminación del río, que era la única fuente de agua potable de dichas minorías, afectando de esta manera al acceso a una alimentación adecuada y al agua potable y energía eléctrica. Asimismo, se expresa preocupación por el hecho de que no existe una sentencia firme y definitiva después de más de diez años desde el vertimiento de los sedimentos. En este sentido, también se expresa preocupación por el presunto incumplimiento de las medidas impuestas a la Empresa de Energía del Pacífico (EPSA) por el Ministerio de Medio Ambiente y Desarrollo Sostenible.

Allegation that the Dutch celebration of Black Pete, also known as “Swarte Piet”, which, each year, is part of the Saint Nicholas Event (5 December), and precedes and accompanies the celebration of Santa Claus, perpetuates a stereotyped image of African people and people of African descent. According to the information received, proposals have been made to declare the Dutch Cultural Historical Tradition “Santa Claus and Black Pete” as Immaterial Cultural Heritage, and the Dutch authorities have selected the annual Saint Nicolas Event (December 5) as one of the intangible heritages to be submitted for inclusion in the UNESCO list.
