Information received concerning concerning the alleged arbitrary detention, torture, and ill-treatment of Mr. Saeed Bakhouche, who was cleared for release and transferred from the detention facility at the U.S. Naval Station Guantánamo Bay to Algeria on 20 April 2023. We are profoundly concerned that Mr. Bakhouche’s ongoing detention is unfounded and will further aggravate his already tenuous mental and physical state and exposes him to human rights violations, including enforced disappearance.

Information received regarding five South African nationals arbitrarily detained in the al-Roj camp in North-Est Syria. We express deep that one of the female detainees suffers from severe and deteriorating chronic health problems and urgently needs access to medical care that is unavailable in the camp. Furthermore, we are deeply concerned that the 14-year-old boy is at serious risk of being forcibly separated from his family and transferred to another detention centre, where he is at risk of disappearing and being held in incommunicado detention in life-threatening conditions.

Information received concerning the alleged arbitrary restriction of the right to freedom of peaceful assembly of individuals, principally persons with disabilities, protesting against a lack of government funding and public infrastructure for persons with disabilities in the Republic of Korea. We also wish to raise our concerns regarding the reported physical and verbal intimidation and harassment of protesters by security forces during demonstrations, as well as the reported use of verbally intimidating language against the protesters and persons with disabilities by government and municipal officials. We also raise concerns about police investigations into the actions of these protesters, including the case of Mr. Park Kyeong-Seok.

Information concerning the redevelopment plan 3080+ which is expected to involve the large-scale demolition of houses and the eviction of tenants in multiple districts in Seoul and other suburban areas as part of the Government’s broader housing policies aimed at boosting housing supply. Many of these redevelopment plans appear to be implemented without sufficient consultation or meaningful participation of all affected residents living in these areas, including in the design and implementation of these plans. In addition, the redevelopment projects appear not to include sufficient protection of marginalized community members living in the affected areas, and to ensure inadequate protection of the historic built environment, the culture, and the social networks of affected communities. If these redevelopment plans were to be implemented unchanged, there is the risk that several of the affected persons will be fully displaced with limited opportunities to return to their earlier place of residency.

Alleged imposition of the death penalty against 22 South Sudanese nationals on charges not meeting the threshold of most serious crimes, and sentencing to life imprisonment of three others by the Sudanese Anti-Terrorism Court, after judicial proceedings that did not fulfil the most stringent guarantees of fair trial and due process. According to the information received, on 6 April 2016, a judge of the Sudanese Anti-Terrorist Court in Khartoum sentenced 22 South Sudanese men, allegedly all former members of Justice and Equality Movement-Debajo Wing (JEM-Debajo), a Darfuri armed group, to death by hanging on charges of terrorism, fighting the State, bearing arms against the State and undermining the constitutional order. Three of the 22 men sentenced to death were underage at the time of the commission of the alleged crimes, and one of them has a psychosocial disability. Three others were sentenced to life imprisonment, allegedly after admitting to having served as cooks and mechanics within JEM-Debajo. The trial of all 25 men was reportedly conducted entirely in Arabic, a language which the accused do not understand, and without the provision of interpreters they were not able to understand the proceedings.

Alleged negative impact of the Welfare Reform and Work Act on the human rights of persons living in poverty, particularly children, large families, single parents and persons with disabilities. According to the information received, the Welfare Reform and Work Act, enacted in March 2016, introduces major cuts in social benefits, including, inter alia, a lower cap on the household benefit, a four-year freeze on working-age benefits and tax credits, restrictions on child tax credits and reduced support for persons with disabilities in the Work-Related Activity Group. Concerns are raised that these changes have been introduced without adequate assessments of their impact on the rights to social protection and an adequate standard of living, and may contribute to a rise in poverty and inequality.

Allegations of extremely alarming living and care conditions of the internees of the Disability Branch of the Centre of Social Welfare of Western Greece, formerly known as the Children’s Care Centre of Lechaina. According to the information received, this institution, which hosts approximately 55 to 60 persons with intellectual disabilities, including five children, lacks adequate medical and health care professionals. Due to shortage of staff, most internees are allegedly sedated, spend their days in isolation and are confined in cage beds or cells with wooden bars up to the ceiling. Several internees, including young children, have their limbs reportedly strapped to their beds, some in unnatural forced positions. Such conditions could seriously undermine the right of persons with disabilities to liberty and security, to physical and mental integrity, to freedom from cruel, inhuman or degrading treatment, to freedom from all forms of exploitation, violence and abuse, and to the highest attainable standard of physical and mental health.

Alleged torture and imminent execution of a person with disabilities. According to the information received, on 28 July 2015, the Lahore High Court stayed the execution of Mr. Abdul Basit and ordered an assessment of his medical situation. On 17 August 2015, the Court issued a new warrant and re- scheduled Mr. Basit’s execution for 22 September 2015. This second warrant was challenged by Mr. Basit’s lawyers based on the fact that Pakistan’s Prison Rules do not provide any procedures to execute a person who is paralyzed and because of the risk of an appalling death. On 24 November 2015, the Presidency stayed his execution for two months and ordered a new inquiry into the case. Despite repeated requests from Mr. Basiz’s lawyers, details of the medical tests and assessments have not yet been provided by the relevant authorities. Mr. Basit’s two-month stay of execution expired on 23 January 2016 and another execution warrant could be issued at any time. This case was the subject of an earlier communication sent on 24 July 2015, see A/HRC/31/79, case no. PAK 5/2015.

Seguimiento a la presunta exclusión de facto del sistema general educativo, discriminación e impacto negativo en el estado de salud físico y mental de una niña autista, así como a la respuesta del Gobierno de España a una primera comunicación sobre el caso. Según la información adicional recibida, la niña autista de 10 años que habría sido excluida de facto del sistema general de educación todavía seguiría sin tener asignada una escuela para el curso académico 2015-2016, debido a la falta de un plan de intervención pedagógico y de alternativas válidas por parte del Estado que cumplan con las necesidades de ajustes razonables y recursos necesarios para la niña. Se señala asimismo, la necesidad de facilitar un entorno educativo adecuado que asegure el pleno disfrute del más alto nivel de salud física y mental, así como el bienestar de la niña y de su familia. Two months after his release from hospital, he shot dead a man following an altercation. Mr. Ali was charged with manslaughter and detained for approximately one year before his trial. He had no legal representation during the proceedings. Despite his history of serious psychosocial disability, no psychiatric or psychological evaluation was carried out nor was his mental disability taken into consideration by the court. In August 2015, the Regional Court of Somaliland sentenced Mr. Ali to death. Mr. Ali’s family attempted to submit his mental health records to the Appellate Court for its consideration but the Court refused to accept the evidence and upheld the death sentence. Mr. Ali is at imminent risk of execution by firing squad.

Alleged imminent execution, torture and ill-treatment of a person with a psychosocial disability. According to the information received, in 2003, Mr. Khizar Hayat, a Pakistani national and former police officer, was convicted and sentenced to death for the alleged murder of a fellow police officer under section 302 of the Pakistan Penal Code. To date, Mr. Hayat has spent over 12 years on death row. Despite having being diagnosed with paranoid schizophrenia by the detention authorities in 2008, he has never received adequate treatment for his condition, which has continued to deteriorate and made him the target of abuse and attacks by fellow inmates. On 25 July 2015, the Sessions Court in Lahore temporarily stayed Mr. Hayat’s execution, following an application by Mr. Hayat’s lawyer challenging the legality of the warrant on the basis of Mr. Hayat’s psychosocial disability, and a hearing on the issue is scheduled for 30 July 2015. Concern is expressed at the imminent execution, torture and ill-treatment of Mr. Hayat, in contravention of international human rights law.

Alleged torture in prison and imminent execution of a detainee with a physical disability. According to the information received, in 2008, Mr. Abdul Basit, a Pakistani national, was arrested for the murder of the uncle of one of the students registered at ‘Independent College’ where he worked. On 19 May 2009, he was convicted for murder and sentenced to death. On 12 June 2012, the High Court of Pakistan dismissed his appeal and, on 13 December 2012, the Supreme Court rejected a second appeal. Mr. Basit is detained at the Central Jail Faisalabad without adequate medical care and consideration for his permanent paralysis, which is a consequence of the severe detention conditions he has been subjected to. In January 2013, after the exhaustion of all local remedies, Mr. Basit’s family submitted a mercy petition requesting a commutation of his sentence on the basis of, inter alia, his disability based on Rule 107(iv) of the Pakistan Prison Rules (1978). This petition was rejected and the execution warrant for Mr. Basit could be issued at any time.

Réponse à la lettre du 27 mars 2015 du Gouvernement français concernant la situation d’un enfant autiste à risque d’être placé de force dans un Institut Médico-Educatif. Selon les informations reçues, à ce jour cet enfant de 15 ans continue d’être déscolarisé. En réponse à des préoccupations soulevées dans deux communications précédentes, la seule solution indiquée par les autorités compétentes est de le placer dans un Institut Médico-Educatif. Ce type d’instituts a été critiqué par le Comité européen des droits sociaux, en 2013, à cause de leur manque d’objectif éducatif. Le Gouvernement est prié d’adopter toutes les mesures nécessaires pour prévenir l’institutionnalisation de cet enfant et assurer son inclusion scolaire et sociale. Les deux communications précédentes ont été envoyés le 22 décembre 2014, voir référence A/HRC/29/50, cas no FRA 4/2014, et le 12 mars 2015, voir référence A/HRC/30/27, cas no FRA 2/2015.

Alegaciones sobre el presunto asesinato de dos defensores, padre e hijo, de los derechos de las personas con discapacidad en El Salvador. Según la información recibida, tanto el Sr. Israel Antonio Quintanilla –presidente de la Asociación de Lisiados de Guerra (ALGES) y persona con discapacidad- como su hijo el Sr. Carlos Alberto Quintanilla Zavala, habrían desaparecido el 1 de mayo de 2015 tras haber participado en la marcha del día de los trabajadores. El 4 de mayo de 2015, el cadáver del Sr. Quintanilla habría sido encontrado en Santa Cruz Turillo y el día siguiente, el cuerpo del Sr. Quintanilla Zavala habría sido hallado en las cercanías del cadáver de su padre. Preocupa que los presuntos asesinatos puedan estar ligados a su trabajo en defensa de los derechos de las personas con discapacidad a consecuencia del conflicto armado en El Salvador.

Presuntas violaciones del derecho a la educación inclusiva y discriminación de una niña autista. De acuerdo con la información recibida, desde el 20 de marzo de 2015, una niña autista de 10 años ha sido excluida del sistema general de educación, cuando en un colegio de la provincia de Málaga, las familias de sus compañeros de clase expresaron rechazo a su presencia en el aula, mediante una huelga, afectando su salud física y mental. Siguiendo las recomendaciones de los profesionales que acompañan el desarrollo de la niña, los padres decidieron que dejara de acudir a clase y solicitaron a la Delegación Territorial de Educación, Cultura y Deporte en Málaga su reubicación urgente en otro colegio. Esta solicitud se fundamentó, tanto en la falta de ajustes razonables y de recursos necesarios, como en la imposibilidad de reconstruir un entorno educativo adecuado. Hasta la fecha la niña continua excluida del sistema regular de educación.

Alleged deletion of two key provisions from an omnibus legislative bill concerning persons with disabilities, which will be subject to a second reading in the Parliament of the Republic of Moldova on 7 May 2015. According to the information received, the bill was originally introduced at the initiative of the Ministry of Labour, Social Protection and Family, with proposals for three amendments which would advance the Republic of Moldova’s implementation of the Convention on the Rights of Persons with Disabilities. Nevertheless, it appears that the proposals relating to establishing the right to vote for persons under guardianship, and recognizing the right of persons under guardianship to have legal standing to challenge in court decisions on their placement under guardianship, have been excluded by the Parliamentary Committee from the bill currently under consideration by Parliament.

Alleged forced eviction and continued residency in an institutional setting for 14 persons with intellectual and psychosocial disabilities in the city of Balti who have, until now, benefited from a supported housing programme administered by the city. According to the information received, the Municipal Council of the city of Balti, to date among the most advanced Moldovan localities in providing community support services to persons with intellectual and psychosocial disabilities, has through Decision No. 1/94 decided to discontinue its protected housing programme. This would leave eight persons with disabilities, who currently live in supported apartments, without a place to live with the risk of institutionalization. The deinstitutionalization of a further six persons with disabilities who were waiting to be deinstitutionalized and move from residential institutions to apartments supported by the housing programme would be discontinued.

In 2008, when living in Adelaide, he was found not guilty for the crime of attempted homicide for reason of mental impairment, and was ordered by the court to be transferred to the State’s highest-security mental health hospital, James Nash House, for a 13 year period. After nine months, in September 2009, officials at James Nash House transferred Mr. X to the Yatala Labour Prison, reportedly due to a lack of capacity for dealing with patients with “personality disorders”. At Yatala Labour Prison, Mr. X reportedly remained in solitary confinement for five years and a half, until January 2015. He is confined to his cell for 23 hours a day with only one one-hour break where he is placed in a cagelike structure outdoors rather than the open yard. It is also reported that Mr. X has repeatedly been subjected to additional punitive measures, including handcuffing regimes (for nearly one year), and loud music blasting into his cell for four hours.

Presuntas restricciones del acceso a un aborto legal y seguro por parte de las menores y mujeres con capacidad legal modificada. Según las informaciones recibidas, la Proposición de Ley Orgánica 122/000195 para reforzar la protección de las menores y mujeres con capacidad modificada judicialmente en la interrupción voluntaria del embarazo, presentada ante la Mesa del Congreso de los Diputados el 18 de febrero de 2014, en caso de ser adoptada, limitaría el acceso al aborto a las menores de 16 y 17 años así como a las mujeres con capacidad modificada judicialmente privándolas de sus derechos de igualdad sexual y salud reproductiva y restringiendo indebidamente su derecho al más alto nivel de salud física y mental.

Suivi d'un appel urgent concernant des allégations de refus du droit à l'éducation et menaces d'institutionnalisation forcée d’un enfant autiste. Selon les informations reçues, depuis septembre 2014, cet enfant est déscolarisé et la seule réponse indiquée par les autorités compétentes est son placement dans un Institut Médico-Educatif (IME). L’inscription au collège du nouveau lieu de résidence de l’enfant aurait été refusée contrairement à la Loi du 11 février 2005, selon laquelle tout enfant présentant un handicap ou un trouble invalidant de la santé doit être inscrit dans l’un des établissements le plus proche de son domicile. De plus, le 18 février 2015, le juge du tribunal pour enfants aurait autorisé le placement de l’enfant au domicile de son père, qui aurait eu l’autorisation d’inscrire son fils en IME. Allegations of violations of the right to life of persons with albinism. According to the information received, between June 2013 and January 2015, at least seven persons with albinism, including five young children, and two adults, Mr. Yohane Kamwendo (20 years old) and Ms. Malita Makolija (years 68 old), were kidnapped and killed in Malawi. The authorities reportedly failed to investigate the cases properly. Persons with albinism in the regions of Blantyre, Zomba, Dedza, Muloza, Machinga and, Matindira are living in fear of further attacks. Concern is expressed about the kidnappings and killings of Mr. Kamwendo and Ms. Makolija as well as the lack of investigation concerning their cases. Concern is also expressed about the security and the right to life of other persons with albinism living in the areas affected by these crimes.

Allégations d’exécutions arbitraires et de menaces de mort contre des personnes atteintes d’albinisme. Selon les informations reçues, le 12 décembre 2014, le corps de Mr. Minani Cyriaque, 25 ans et personne atteinte d’albinisme, a été retrouvé sur la colline de Rutenderi, région de Gatabo, recouvert de blessures et amputé d’une jambe emportée par les criminels. Les deux autres albinos de sexe masculin que compte la communauté, Viateur-Vianney Baranyizigiye et François Kabura, craignent pour leur sécurité en raison de rumeurs persistantes sur une récompense d’environ 1000 euros pour toute livraison d’organes de personnes atteintes d’albinisme. De graves préoccupations sont exprimées quant aux allégations concernant les circonstances de la mort de Mr. Cyriaque ainsi que sur les menaces qui pèsent sur la vie des deux autres survivants précités.

Allégations concernant le refus du droit à l’éducation et menaces d’institutionnalisation forcée d’un enfant autiste. Selon les informations reçues, X, 15 ans, a été expulsé à maintes reprises de l’école depuis 2006, lorsqu’il avait sept ans, et cela jusqu’à présent, sur la base de son handicap. Après plusieurs tentatives infructueuses de la mère de l’enfant de le garder inscrit dans le système d’éducation général, durant cette période elle a cherché à obtenir sans succès des recours sur les plans administratifs et judiciaires, X a été menacé par diverses autorités, y compris le Procureur de la République, d’être interné dans une « Institution Médico-Educative » qui accueille des enfants autistes. En 2013, le Conseil de l’Europe a critiqué ces institutions à cause de leur manque d’un objectif éducatif.
