Information received concerning the alleged prolonged and indefinite detention of Mr. Umar Khalid, an Indian human rights defender and student activist, who was arrested on 13 September 2020 allegedly on politically motivated counter-terrorism charges, and who has remained in detention without trial for more than five years. Mr. Khalid’s detention is based on allegations of conduct violating, among others, the Unlawful Activities Prevention Act (UAPA). We therefore also wish to reiterate concerns regarding the compatibility of the UAPA with India’s obligations under international human rights law, as previously raised with your Excellency’s Government in IND 7/2020 and IND 10/2023.
