Information received about the negative impact on human rights of sanctions imposed by the United States of America as the result of its designation of certain countries as state sponsors of terrorism (SST) under domestic legal authority granted initially by the Arms Export Control Act, section 40; the Foreign Assistance Act, section 620A, and subsequently continued by National Defense Authorization Act for Fiscal Year 2019, section 1754(c); as well as by Paragraph 1605A of USC Title 28, Part IV, Chapter 97; and other U.S. laws that trigger specific sanctions when a country is listed as an SST. The sanctions raise serious rule-of-law and human rights concerns.

Information concerning the negative impact on the right to health and other human rights resulting from responses by pharmaceutical companies to U.S. sanctions against Iran. Specifically, I have received information that a subsidiary of the Swiss company Novartis AG (Novartis) has stopped providing at least some vital medications for Iranians suffering from thalassemia, and the French company Roquette Frères (Roquette) has stopped providing to Iran the ingredients it produces for making medicines used in treating thalassemia, following the re-imposition and expansion of U.S. sanctions against Iran since 2018, even though the sanctions permit the continued sale to Iran of products of a humanitarian nature.

Information concerning difficulties encountered in establishing a durable flow of vital medical supplies to Iran in the context of U.S. sanctions against the country; and particularly the reluctance of key parties to be involved in the supply despite the exemptions that are supposed to allow humanitarian goods to be shipped to Iran. This reluctance, due to substantial overcompliance with the sanctions, has impeded the establishment of lasting arrangements for procuring and shipping medical supplies to Iran, forcing a shift toward ad hoc arrangements that add complexity, time, costs and uncertainty to the supply process, which negatively impact the right to health and right to life of patients for whom the supplies are destined.

Alleged adverse human rights impact related to numerous provisions within the Trans-Pacific Partnership (TPP). According to the information received, the TPP was drafted opaquely, without broad consultations, preventing certain stakeholders, including indigenous peoples, from meaningfully participating in the negotiation process. Certain provisions of the TPP related to intellectual property rights may have a detrimental effect on the realization of the right to the highest attainable standard of physical and mental health, to live in a clean environment, to enjoy the benefits of scientific progress and to participate in cultural life. Serious concern is expressed at provisions relating to the dispute settlement mechanisms before which individuals do not have legal standing and thus are deprived of the right to an effective remedy, and at the investor-State dispute resolution mechanism, which allows investors to challenge laws and policies that promote and protect human rights. The negative impact on access to medicines by the TPP was the subject of a previous communication sent on 19 July 2011, see A/HRC/19/44, case nos. AUS 4/2011, BRN 1/2011, CHL 3/2011, MYS 8/2011, NZL 1/2011, PER 3/2011, SGP 2/2011, USA 13/2011 and VNM 5/2011.
