Información recibida en relación con la promulgación de nuevas normas jurídicas, concretamente: I) La Ley Orgánica para el Fortalecimiento de Áreas Protegidas, de 11 de julio de 2025; y II) El Decreto Ejecutivo No. 60, de 24 de julio de 2025, que dispone la implementación de medidas de reorganización institucional en el ámbito de la Función Ejecutiva. Dichas normas que han sido promulgadas en el marco de “Plan de Eficienca Administrativa” mediante el cual el gobierno busca una reforma institucional con “criterios de optimización, austeridad y eficiencia” podrían ser regresivas para la protección de los derechos humanos, incluyendo el derecho humano al ambiente limpio, saludable y sostenible, reconocido en la Constitución de la República del Ecuador, en el Sistema Interamericano y por el Sistema de Naciones Unidas. Las normas podrían también ser contrarias a la obligación internacional del Estado de prevenir daños al ambiente, incluyendo al sistema climático.

Concerns the human rights situation of Indigenous Peoples in Indonesia. These include the lack of formal recognition of Indigenous Peoples; the erosion of their rights under the revised Special Autonomy Law in West Papua; the revival of the transmigration policy and its detrimental impact on cultural integrity; and the adverse effects of National Strategic Projects, extractive industries, and green energy initiatives on Indigenous lands and livelihoods. We also highlight specific cases, such as the expansion of nickel mining in Kabaena and its impact on the Bajau Indigenous Peoples and the dispossession and threats faced by the Cek Bocek Indigenous Peoples in Sumbawa. We have also received allegations of the exclusion of Indigenous communities from conservation efforts, affecting their territories, lands and resources. Additional concerns include the criminalization of Indigenous land defenders and the existential threats faced by Indigenous Peoples in isolation.

Informations reçues concernant les effets négatifs réels et potentiels sur les droits humains d'un projet d'exploitation de sables minéraux critiques dans le sud-ouest de Madagascar, le projet Base Toliara, exploité par Base Resources, propriété de la société américaine Energy Fuels Inc. Les principaux investisseurs d’Energy Fuels sont BlackRock Inc. et Alps Advisors Inc., tous deux basés aux États-Unis, ainsi que Mirae Asset Global Investments, basé en République de Corée. Le projet Base Toliara empiéterait sur les terres des communautés, qui risqueraient ainsi de perdre leurs terres et leurs moyens de subsistance. Le projet présenterait également de graves menaces environnementales qui auraient des répercussions sur les moyens de subsistance et la santé de la population locale. Les manifestations publiques des communautés locales contre le projet auraient été violemment réprimées, entraînant cette année la mort de trois personnes le 23 mars 2025 et la détention de vingt autres entre mars et mai 2025.

In this regard, we express our deepest concern regarding the impact this draft legislation, if adopted, will have on the enjoyment of human rights, including the right to a clean, healthy and sustainable environment; the rights to life and health, and the rights of Indigenous Peoples and Quilombola communities, particularly considering heightened risks for human rights in the context of climate change as dramatic climate events have already taken lives and led to massive loss and damage in Brazil. In addition, it would contravene the current measures and commitments taken by your Excellency’s Government to set out clear expectations for businesses regarding their responsibility to respect human rights, as well as regarding environmental and climate action.

Information received concerning the alleged reiterated and widespread suppression of local activists, human rights defenders, and journalists during the peaceful assemblies held from 23 to 28 April 2023, that were protesting against the construction of a refinery and petrochemicals facility in the village of Barsu, in Ratnagiri, Maharashtra, due to the human rights, environmental and climate impacts of the refinery. In this regard, we also received information about the alleged arrest of environmentalists Mr. Mangesh Chavan and Mr. Satyajit Chavan on 23 April 2023.

Information received updated concerning allegations of the severe environmental, climate and human rights impacts as well as a systematic pattern of oppression and human rights violations against environmental human rights defenders in Uganda in relation with the East African Crude Oil Pipeline (EACOP) and the Tilenga and Kingfisher Projects. According to the information received these include at least 129 alleged arrests and detentions; the incommunicado detentions and ill-treatment of multiple environmental human rights defenders, including recurrent arrests and detentions; and forced disappearances; the forced eviction of more than 42 communities; and widespread judicial harassment. These attacks and threats appear to be directly related to the legitimate human rights activities of the environmental human rights defenders, especially their defence of the right to a clean, healthy and sustainable environment. Reports indicate that such alleged pattern of human rights violations has been ongoing since at least 2022 and persists to this date.

Los esfuerzos de reconstrucción del Gobierno, se están llevando a cabo sin tomar en cuenta las aspiraciones y las recomendaciones del pueblo raizal y de sus autoridades, ignorando su forma de vida y sus costumbres, así como el clima de las islas. Debido a la insuficiente adecuación de las nuevas viviendas a las condiciones climáticas de las islas, la situación queda crítica y conlleva el riesgo que las personas interesadas se desplacen de nuevo y se queden sin hogar cuando golpee el próximo huracán. Además, la prioridad acordada a las necesidades militares y de desarrollo económico sobre la satisfacción de las necesidades inmediatas de la población en términos de vivienda, alimentos, agua potable y saneamiento, y un medio ambiente limpio, significa una presión importante sobre el espacio vital de los Raizales que afecta negativamente su autodeterminación, sus derechos culturales y su derecho al desarrollo, con graves repercusiones sobre su sobrevivencia en tanto que pueblo.
