Information received concerning alleged measures of systematic repression against persons ostensibly affiliated with the Gülen Movement through the misuse of counter-terrorism legislation, and the concomitant impact on civil society, human rights defenders, political dissidents, and journalists. These measures include: (i) mass arrests, detentions, and judicial control orders; (ii) transnational renditions; (iii) the expansion of terrorist “grey lists”; and (iv) the misuse of surveillance powers.

Information received regarding concerns about systemic lack of due process guarantees in cases of alleged terrorism, lawyers and human rights defenders in Diyarbakır are facing arrests and judicial harassment, with individuals currently on trial for their professional activities under the accusation of “membership of an armed/terrorist organization” and others remaining under pending investigations; in a context of actions taken by the Executive that interfere with the Judiciary and infringe on its independence.

Information received concerning the threats and alleged attack, possibly amounting to torture, of Mr. Aytekin Aktaş while he attempted to carry out his professional duties as a human rights lawyer assisting members of the “Life Watch” protests. We also wish to communicate the alleged repression of the “Life Watch” movement by the Gendarmerie which in some cases involves threats and physical violence.

Concern with the framework of anti-terrorism laws implemented by Your Excellency’s Government and its compatibility with Turkey’s international and human rights law obligations. In particular, we express serious concern with Anti-Terror Law No. 3713 (“Anti-Terror Law”) and the amendments made to this law and the Penal Code through Law No. 7145 adopted on 31 July 2018.
