Information received concerning the following comments on the Law of the Republic of Tajikistan on Combating Terrorism (hereafter “CT Law”) and the Criminal Code of the Republic of Tajikistan (hereafter “Criminal Code”). We respectfully address a number of serious human rights challenges in relation to the definition of terrorism contained in the legislation which, in our view, is overly broad, the negative and disproportionate impact of the legislation on particular groups, on due process, as well as on the exercise of freedom of opinion and expression, and freedom of peaceful assembly and association. We therefore respectfully encourage your Excellency's Government to review and reconsider certain key aspects to ensure that the law complies with Tajikistan's international human rights obligations. We recall that Special Procedures Experts have raised concerns on some of these issues, particularly in relation to the Pamiri minority (communications TJK 1/2022, TJK 2/2022 and TJK 3/2022), to which the Government has not yet responded.
