Comments on the Law No. (58) Of 2006 With Respect to Protecting the Society from Terrorist Acts and the Bahraini Citizenship Act of 1963 as amended in 2014 and 2019 respectively. We respectfully address several serious human rights challenges in relation to the definition of terrorism contained in the legislation which, in our view, is overly broad; the negative and disproportionate impact of the legislation may have on particular groups, on due process, on the right to liberty and security of person, as well as on the exercise of freedom of opinion and expression, and freedom of peaceful assembly and association. We respectfully encourage your Excellency's Government to review and reconsider certain key aspects of the law to ensure that it complies with Bahrain's international human rights obligations. We would also like to reiterate the observations made in AL BHR 2/2019 on the Law No. (58) Of 2006 With Respect to Protecting the Society from Terrorist Acts.

Abdelnasser Ahmad Mahmoud Abou Taqiqa al-Huwaiti, Mahmoud Ahmad Mahmoud Abou Taqiqa al-Huwaiti and Abdullah Dakhilallah al-Huwaiti, have been handed severe prison sentences. The six, along with other members of the Howeitat tribe, have been resisting evictions from their homes under the NEOM project, part of the Saudi 2030 Vision. The NEOM project is being implemented allegedly without genuine consultation, free prior and informed consent, and access to effective remedies of the Howeitat tribe, whose members have been threatened with evictions from Al Khuraiba, Sharma and Gayal villages. NEOM is a project of the Saudi Public Investment Fund, which owns 100% of a closed joint-stock company named Neom. Information received concerning the imminent risk of execution of three persons and long prison convictions of three others, in the context of alleged persecution of members of the Howeitat tribe. Messrs. Shadly Ahmad Mahmoud Abou Taqiqa al-Huwaiti, Ibrahim Salih Ahmad Abou Khalil al-Huwaiti and Atallah Moussa Mohammed al-Huwaiti, have been sentenced to death. Messrs. Abdelnasser Ahmad Mahmoud Abou Taqiqa al-Huwaiti, Mahmoud Ahmad Mahmoud Abou Taqiqa al-Huwaiti and Abdullah Dakhilallah al-Huwaiti, have been handed severe prison sentences. All are convicted for terrorist acts, which are allegedly baseless, and they are rather being punished for merely voicing their opposition to the forced evictions of the Howeitat tribe, including on social media. Some of them have allegedly been subjected to torture and ill-treatment while in custody, including prolonged solitary confinement, for the purpose of extracting confessions. A number of international companies, have been allegedly involved in different stages of the development of the Neom Project.

Concern on the recently proposed Anti-Terrorism Act (ATA) published on 17 March 2023, which represents the latest development of your Excellency’s Government response to the challenges posed by the Prevention of Terrorism Act of 1979 (PTA) and the Rehabilitation Bill passed by the Sri Lankan Parliament on 18 January 2023. This legislation followed previously proposed legislation which sought to establish a Bureau for the Rehabilitation of ‘drug addicts, war warriors, and violent extremists.’ We note that revisions to the Rehabilitation Bill following a decision of the Supreme Court do not adhere in certain regards to fundamental rights enshrined in the Constitution, in our view have not remedied the substantive deficiencies of the legislation, and therefore place many of its provisions in direct contradiction with the international human rights law obligations of your Excellency’s Government.

Information received concerning the conditions of detention and treatment of Mr. Karim Massimov who is currently being held in pretrial detention and whose health, it is reported, has deteriorated to such an extent that there are concerns for his life and well-being. Among the many allegations, I am particularly preoccupied by his continuous period of 12 months in solitary confinement which, if credible, would be in clear violation of international standards and a good faith application of those standards; the physical conditions of his cell and the impact on his health, and restrictions on access to proper medical care and medications. Either individually or cumulatively, such treatment or conditions – if established – would amount to torture or cruel, inhuman or degrading treatment or punishment in violation of international law.
